Bailey Counsel for the Dist ct General Manage ISSUE: A resolution of the Board of Directors is required to accept easements, to execute quitclaim deeds and to record the documents. RECOMMENDATION: Adopt a resolution accepting six grants of easements, authorizing the execution of five related quitclaim deeds, and authorizing staff to record the documents with the Contra Costa County Recorder. FINANCIAL IMPACTS: A total of $86,300 was paid to five of the six property owners for permanent easements related to the Diablo Sewer Renovations Project, Phase 2 (DP 5976) as follows: Property Owners) Amount Episcopal Bishop of California $23,000 Kathleen A. STAMPFLI, AND DIABLO COUNTRY CLUB (DISTRICT PROJECT 5976 — PARCEL 1, 2, 3, 7, 8, & 9 *) LOCATED IN DIABLO, AND AUTHORIZING THE EXECUTION AND RECORDING OF FIVE QUITCLAIM DEEDS ABANDONING EXISTING EASEMENTS AND RECORDING THE GRANTS OF EASEMENT AND QUITCLAIM DEEDS BACKGROUND: When the District replaces or renovates sewer lines, the alignment of the new pipe does not always align perfectly with existing District easements. When this occurs, the District must modify or acquire new easements to coordinate with the location of the new lines. Correspondingly, some existing easements may no longer be needed, in which case the District quitclaims them back to the property owners. As part of the Diablo Sewer Renovations Project, Phase 2 (District Project 5976), the District installed and rehabilitated approximately 9,350 feet of 6 -, 8 -, 10- and 12 -inch sewer pipe by open cut, pipe bursting, and horizontal directional drilling methods. A total of six new easements were acquired for this project affecting the property owners listed in Exhibit A to the attached proposed resolution. There are also five existing easements that are no longer needed, as listed in Exhibit B to the attached proposed resolution. Board action is needed to accept the six new permanent easements and quitclaim the five existing District easements that are no longer needed. RECOMMENDED BOARD ACTION: Adopt a resolution: (1) accepting grants of easements from the property owners of the parcels listed in Exhibit A to the attached proposed resolution, (2) authorizing the execution of quitclaim deeds as listed in Exhibit B to the attached proposed resolution, and (3) authorizing staff to record the documents with the Contra Costa County Recorder. Proposed Resolution, including Exhibits A and B N:WDMINSUPWDMIN \DIST- SEC \Position Papers\2014 \PP GOE Diablo 2 3 -20 -14 Final (3).doc Page 2 of 2 RESOLUTION NO. 2014 -007 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT ACCEPTING SIX GRANTS OF EASEMENTS AND AUTHORIZING THE EXECUTION OF FIVE QUITCLAIM DEEDS RELATED TO DIABLO SEWER RENOVATIONS PROJECT, PHASE 2 (DISTRICT PROJECT 5976) BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (District) as follows: THAT the District accepts six Grants of Easements (Sewer Purposes) from the property owners in the Diablo Sewer Renovations Project, Phase 2, as listed in Exhibit "A" hereto (District Project 5976 — Parcels 1 -3 and 7 -9); and the District hereby authorizes the execution of five Quitclaim Deeds, each dated March 20, 2014, to the property owners in Danville and Diablo as listed on Exhibit "B "; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said deeds for and on behalf of the District; and THAT staff is authorized to record the documents in the office of the Recorder of Contra Costa County.
