Gemmel[ — Environmental Services Division Manager Aim R. Bailey Counsel for the District General Manager ISSUE: A resolution of the Board of Directors is required to record lease agreements. RECOMMENDATION: Adopt a resolution authorizing the General Manager to execute a new General Lease agreement with the State Lands Commission at the Martinez Marina; and authorize staff to record the agreement with the Contra Costa County Recorder. FINANCIAL IMPACTS: The application processing fee for the lease was $3,000 plus a $25 filing fee. The annual rent consideration for these facilities is the public use and benefit. ALTERNATIVES /CONSIDERATIONS: The Board could decline to approve the renewed lease. BACKGROUND: The State Lands Commission approved a new 45 year General Lease for Public Agency Use of sovereign land for operation, use and maintenance of an eight -inch diameter sewer pipe located at the Martinez Marina, adjacent to North Court Street in Martinez. The lease was approved at the Commission's September 20, 2013 meeting. The term of the lease commenced October 25, 2013 and will end October 24, 2058. The District's previous lease expired October 24, 2013. RECOMMENDED BOARD ACTION: Adopt a resolution to authorize the General Manager to execute a new General Lease agreement with the State Lands Commission at the Martinez Marina, and authorize staff to record agreement, (APN 373 - 040 -003). Proposed Resolution ATTACHMENT 1 RESOLUTION NO. 2014 -OOY A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT AUTHORIZING THE GENERAL MANAGER TO EXECUTE A NEW GENERAL LEASE AGREEMENT WITH THE STATE LANDS COMMISSION (APN 373 - 040 -003) NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (District) as follows: THAT the District hereby authorizes the General Manager to execute a new General Lease agreement with the State Lands Commission, for the property located adjacent to North Court Street in Martinez, CA (APN 373 - 040 -003); and THAT District staff are authorized to record the Agreement in the office of the Recorder of Contra Costa County.
