ISSUE: Board of Director's authorization is required for a leave of absence without pay
in excess of 30 days.
RECOMMENDATION: Authorize leave of absence without pay for Maralee Davi, Utility
Worker.
FINANCIAL IMPACTS: Currently, the District is only paying for Ms. Davi's medical and
dental insurance resulting in a monthly cost of $880.35.
ALTERNATIVES /CONSIDERATIONS: At this time, there are no other alternatives as
the District cannot lawfully terminate Ms. Davi's medical leave of absence until the
District has exhausted the interactive process and a determination can be made
whether or not she can return to work.
BACKGROUND: Ms. Davi has been on a Family Medical Leave Act (FMLA) protected
leave of absence without pay since May 13, 2013. Ms. Davi exhausted her FMLA leave
on July 11, 2013, hence the need to now request Board authorization for an unpaid and
unprotected leave of absence exceeding 30 days. Staff is currently engaging in the
interactive process, as mandated by law, with Ms. Davi to determine whether or not she
can return to work.
Since this request exceeds the 30 working days that the General Manager and
Department Director may approve, Board of Directors' authorization is required.
RECOMMENDED BOARD ACTION: Authorize a leave of absence without pay for
Maralee Davi, Utility Worker through September 19, 2013.
