WASTE HANDLING ASSISTANCE

ISSUE: In accordance with purchasing procedures, Board authorization is required for the
General Manager to execute a technical consulting services agreement in an amount
greater than $100,000.
RECOMMENDATION: Authorize the General Manager to approve a revision to the
technical consulting services agreement not to exceed $200,000 with Environmental and
Occupational Risk Management (EORM), Inc., for the Safety and Hazardous Waste
Handling Services.
FINANCIAL IMPACTS: The total anticipated cost for the work under this agreement is
$200,000.
ALTERNATIVES /CONSIDERATIONS: The Board could reject the proposed contract.
However, this is not recommended due to the shortage of Safety staff and the importance of
the safety training and investigations included in the contract scope.
BACKGROUND: The Plant Operations Safety Officer retired with short notice in May 2013.
As a result, the implementation of the new safety training database, Train Track, was not
completed. At the same time, Plant Operations determined that, due to its Large Quantity
Generator status, the department is no longer eligible to use the District's Household
Hazardous Waste Collection Facility for hazardous waste disposal. Thus, a Hazardous
Materials Management Program is needed for Treatment Plant Operations to comply with
State and Federal regulations.
During recent monthly inspections, numerous petroleum seeps have been found in the
Basin A South soil cap. These seeps require immediate repairs for compliance with the
Department of Toxic Substance Control (DTSC)'s requirements. During the last inspection
that was conducted on July 18, 2013, 45 petroleum seeps were identified.
Recently, significant levels of lead- containing ash were discovered in the Solids
Conditioning Building (SCB) at the Treatment Plant. This finding requires a more thorough

investigation and possible clean -up to ensure that the work environment will meet OSHA
requirements.
EORM was selected through a request for proposal process earlier this year to perform an
audit of the District's Safety program and processes, and to provide follow -up on safety
services.
The initial agreement with EORM was for $24,000. The cost of additional safety
investigations and technical support included in this revision is $176,000. The revised cost
ceiling of the agreement will be $200,000.
RECOMMENDED BOARD ACTION: Authorize the General Manager to approve a revision
to the technical consulting services agreement with EORM, Inc., in an amount not to exceed
$200,000 for assistance with safety and hazardous materials handling.
