Central Contra Costa Sanitary District ' BOARD OF DIRECTORS POSITION PAPER Board Meeting Date: July 25, 2013 Subject: CONDUCT A PUBLIC HEARING TO RECEIVE COMMENTS ON AND CONSIDER ADOPTION OF A RESOLUTION DIRECTING THAT THE FISCAL YEAR 2013 -14 CAPACITY USE CHARGES, ASSESSMENTS FOR CONTRACTUAL ASSESSMENT DISTRICTS, ASSESSMENTS FOR ALHAMBRA VALLEY ASSESSMENT DISTRICTS AND ASSESSMENTS FOR OTHER FEE INSTALLMENT PAYMENT PROGRAMS BE COLLECTED ON THE CONTRA COSTA COUNTY PROPERTY TAX ROLL Submitted By: Initiating Dept. /Div.: Earlene Millier, Engineering Assistant III Engineering /Environmental Services REVIEWED AND RECOMMENDED FOR BOARD ACTION: T. Brightbill — Senior Engineer ov% D. Gemmell — Environmental Services Division Mgr. K. Alm C. swan ;on Counsel for the District Provisional General Manager ISSUE: A resolution of the Board of Directors passed by four affirmative votes is needed to place charges on the Contra Costa County property tax roll for collection. RECOMMENDATION: Adopt a resolution directing that the Fiscal Year (FY) 2013 -14 Capacity Use Charges, assessments for the Contractual Assessment Districts (CADs), assessments for the Alhambra Valley Assessment Districts (AVADs), and assessments for other fee installment payment programs be collected on the Contra Costa County property tax roll. FINANCIAL IMPACTS: This action will provide for collection of approximately $120,000 in FY 2013 -14 charges from customers participating in the District's Capacity Use Program; approximately $148,000 in FY 2013 -14 assessments from properties that formed CADs; $185,000 in FY 2013 -14 assessments from properties that formed AVADs; and $28,000 in FY 2013 -14 assessments for other fee installment payment programs. ALTERNATIVES /CONSIDERATIONS: Direct collection of these charges by District staff is an alternative. However, it is economical and efficient to collect the charges on the property tax bills, and the owners of the listed parcels have signed agreements allowing this. BACKGROUND: Certain commercial tenants and commercial property owners have entered into written agreements to participate in the District's Capacity Use Program for payment of Capacity Fees over a fifteen -year period. These businesses are listed in Exhibit A (attached).
