ISSUE: The District Code and state law require that the Board of Directors hold a
public hearing prior to considering placement of Sewer Service Charges (SSC) on the
Contra Costa County property tax roll for collection.
RECOMMENDATION: Set August 1, 2013 at 2:00 p.m. as the date and time for a
public hearing to consider placement of the FY 2013 -14 SSCs on the County property
tax roll for collection.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: The SSCs could be collected through direct
billings by the District. However, the staff recommendation to place these charges on
the tax roll provides the most economical and efficient means for the District to collect
these charges. Direct billing would require significant additional material, mailing, and
labor and benefit costs. The SSC has been collected on the County tax roll since the
inception of the service charge in 1976.
BACKGROUND: In accordance with California Health & Safety Code (H &SC) section
6520.5, after a duly noticed public hearing held on June 20, 2013, the Board of
Directors established the SSC rates for FY 2013 -14 and FY 2014 -15. (The Board will
review and consider the District's proposed budget in the Spring of 2014 to determine
whether the SSC rate increase for FY 2014 -15 will continue to be necessary.)
Section 5473 of the H &SC authorizes the collection of the SSCs on the tax roll. District
Code 6.24.150 and H &SC section 5473.1 require the holding of a public hearing to
consider the written report identifying the properties and their associated charges prior
to being transmitted to the County for collection on the tax roll. Before the hearing, the
written report will be complete and available for review in the District office.

COUNTY TAX ROLL
At the hearing, the Board will hear any objections or protests to the report, and if a
majority of owners of property object to the collection on the tax roll, then the charges
must be billed directly and not placed on the tax roll. At the conclusion of the hearing,
the Board may adopt, revise, change, reduce or modify any charge or overrule any or
all objections to the report.
COMMITTEE RECOMMENDATION: The Budget and Finance Committee will review
this matter prior to the August 1, 2013 public hearing.
RECOMMENDED BOARD ACTION: Set August 1, 2013 at 2:00 p.m. as the date and
time for a public hearing to consider placement of the FY 2013 -14 SSCs on the Contra
Costa County property tax roll for collection.
