ISSUE: Work has been completed on the St. Mary's Road Contractual Assessment
District (CAD) No. 2011 -1 and the final assessment can be established and levied. A
public hearing and a resolution are required to direct that the 2013 -2014 assessment be
collected on the Contra Costa County tax roll and to establish reimbursement fees for
future connectors.
RECOMMENDATION: Establish July 25, 2013 as the date for a public hearing to
receive comments on confirming and levying final assessments for St. Mary's Road
CAD No. 2011 -1, directing that the 2013 -2014 assessment be collected on the Contra
Costa County tax roll; and considering adoption of a proposed ordinance (uncodified) to
establish reimbursement fees for the properties which could directly connect to Job
6513.
FINANCIAL IMPACTS: The action will allow the District to be reimbursed for project
costs.
ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the
recommended public hearing date or may elect to choose a different date. However, a
public hearing must be held if assessments and charges are to be placed on the
County tax roll for collection and participants are to be reimbursed for covering non-
participant costs.
BACKGROUND: On June 7, 2012, the Board of Directors ordered sanitary sewer
improvements for a portion of St. Mary's Road in Lafayette. The project serves 13

properties with 14 connections, including two for the ball fields and community meeting
building owned by the City of Lafayette. The estimated project cost was $375,000. At
the prior meeting on May 17, 2012, the Board approved a CAD Policy exception to
allow the District to cover up to 3.5 non - participant share of the 14 total shares (the
remaining 10.5 shares would be funded by participants and the City of Lafayette) and
several conditions to ensure the District recoups the share of the costs it would cover.
The work to install the improvements has been completed, final costs are ready to be
totaled, and final assessments for each project share can be determined. The Board
will be requested to confirm and levy these final assessments and to authorize a Notice
of Assessment.
After being given an opportunity to pay off their CAD assessment in a lump sum without
interest, property owners instead may choose to pay for sewer improvements over a
ten -year period. Payments are to be collected by placing assessments on each
property owner's tax bill. The Board must conduct a public hearing prior to considering
placement of charges and assessments on the County tax roll for collection and to
establish the reimbursement fees for new connectors to repay participants for covering
non - participant costs.
RECOMMENDED BOARD ACTION: Establish July 25, 2013 as the date for a public
hearing to receive comments on confirming and levying final assessments for St. Mary's
Road CAD No. 2011 -1, directing that the 2013 -2014 assessment be collected on the
Contra Costa County tax roll; and considering adoption of a proposed ordinance
(uncodified) to establish reimbursement fees for the properties which could directly
connect to Job 6513.
