HomeMy WebLinkAboutBOARD MINUTES 05-02-13MINUTES OF THE REGULAR MEETING OF THE DISTRICT BOARD OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT HELD ON MAY 2, 2013 The Board of Directors of the Central Contra Costa Sanitary District convened in a regular meeting in the Board Room, 5019 Imhoff Place, Martinez, County of Contra Costa, State of California, at 2:00 p.m. on Thursday, May 2, 2013. President Nejedly called the meeting to order and requested that the Secretary call roll. 1. ROLL CALL PRESENT: Members: Causey, McGill, Pilecki, Nejedly ABSENT: Members: Williams a. PLEDGE OF ALLEGIANCE TO THE FLAG The Board and staff joined in the Pledge of Allegiance. b. INTRODUCTIONS None. The Board welcomed new employee Rigoberto Casarez, Engineering Assistant I in the Environmental Services Division. 2. PUBLIC COMMENTS 3. AWARDS AND COMMENDATIONS a. PRESENTATION OF CALIFORNIA WATER ENVIRONMENT ASSOCIATION (CWEA) STATE AWARD FOR TREATMENT PLANT OF THE YEAR BY STEVE DOMINGUEZ, VICE PRESIDENT OF CWEA SAN FRANCISCO BAY SECTION Provisional General Manager Curt Swanson announced that, on April 19, 2013, the District received the award for Treatment Plant of the Year greater than 20 million gallons a day (MGD), at the CWEA Annual Conference in Palm Springs. Delta Diablo Plant Manager and Vice President of the CWEA San Francisco Bay Section, Steve Dominguez, described the award and selection process. He stated that the awards, established in 1929, consist of 20 categories, with nominations through 17 sections of the state. He noted that he was personally involved in touring the plants and was impressed with the presentation made by District staff, after which he presented the award to President Nejedly. Approve minutes of Board meetings held on the following dates: March 21, 2013; and April 4, 2013. b. Approve expenditures dated May 2, 2013. Reviewed by Budget and Finance Committee. C. Receive March 2013 Financial Statements and Investment Reports. Reviewed by Budget and Finance Committee. d. Approve the Diablo Sewer Renovations, Phase 2, District Project 5976, for California Environmental Quality Act (CEQA) compliance and permitting purposes, find that the project is exempt from CEQA; and direct staff to file a Notice of Exemption with the Contra Costa County Clerk. e. Approve the Walnut Creek Sewer Renovations, Phase 10, District Project 8413, for CEQA compliance and permitting purposes, find that the project is exempt from CEQA; and direct staff to file a Notice of Exemption with the Contra Costa County Clerk. f. Approve the North Orinda Sewer Renovations, Phase 5, District Project 8411, for CEQA compliance and permitting purposes, find that the project is exempt from CEQA; and direct staff to file a Notice of Exemption with the Contra Costa County Clerk. It was moved by Member McGill and seconded by Member Pilecki to adopt the Consent Calendar as recommended. Motion passed by unanimous vote of the Board. 5. CALL FOR REQUESTS TO CONSIDER ITEMS OUT OF ORDER None. 6. REPORTS a. GENERAL MANAGER 1) Update on issues involving Caffe Classico Foods in Concord Environmental Compliance Superintendent Tim Potter reported that Caffe Classico Foods achieved zero discharge prior to February 28, 2013 and has maintained that status since, as confirmed by District inspections in February, March, and April. Caffe Classico Foods also submitted two enforcement settlement agreement payments of $5,000 prior to their deadlines. In mid - March, a surveillance inspection of a downstream manhole verified that no Book 62 — Page 203 CENTRAL CONTRA COSTA SANITARY DISTRICT Board Minutes of May 2, 2013 processed wastewater discharge was coming to the District. Around that time, staff also issued a final Notice of Violation for violations which occurred before zero discharge was achieved. These were included in the Enforcement Settlement Agreement. Caffe Classico Foods' operations are currently in compliance. However, the property owner (not Caffe Classico Foods) missed its April 30 deadline for $103,000 in owed capacity fees. District staff is in the process of notifying the property owner that these fees will be placed on the assessor's tax rolls. In addition, while inspecting another business, District staff noticed that the tank being used by Caffe Classico Foods to accumulate processed wastewater for hauling to East Bay Municipal Utility District (EBMUD) overflowed. Caffe Classico Foods staff washed residuals into the parking lot, releasing them into storm drain. As Caffe Classico Foods' operation is in an unincorporated area, District staff informed the County, who issued a Notice of Violation accordingly. 2) Announcements The following announcements were included with the agenda packet: a) Resignation of Safety Officer Diane Von Aspern (formerly Hinson), effective May 17, 2013, after five and one -half years with the District b) Northern California Pipe Users Group (PUG) recognizes the District's support and participation C) Regional "Excellence in Water Research" awards to be presented to student winners of the Contra Costa County Science and Engineering Fair d) Recap of contracts signed by General Manager during first quarter 2013 e) Passing of former Board Member George Rustigian D Proposed sewer service charge increases by nearby agencies The following additional announcement was made at the meeting: g) Passing of former Board Member Mario M. Menesini b. COUNSEL FOR THE DISTRICT District Counsel Kent Alm announced the Closed Session scheduled as Item 9.a. SECRETARY OF THE DISTRICT Secretary of the District Elaine Boehme announced the upcoming scheduled May 6, 2013 Enterprise and May 7, 2013 Human Resources Committee meetings. d. BOARD MEMBERS 1) Board Member reports on recent meetings for which they received the stipend; and meetings or conferences for which the District paid their expenses; future meetings or conferences for which they will receive the stipend or for which the District will pay their expenses Member McGill Member McGill reported on the April 24 -26, 2013 California Association of Sanitation Agencies (CASA) Spring Conference in Newport Beach. Member McGill and President Nejedly reported on the April 29, 2013 Budget and Finance Committee meeting and summarized the Action Summary. The Board received the report without comment. 2) Announcements Member McGill provided a written report covering Announcements. He added that he will be attending a Pleasant Hill Chamber of Commerce event that was inadvertently left off his written report. 7. EMERGENCY SITUATIONS REQUIRING BOARD ACTION a. DECLARE AN EMERGENCY AND RATIFY THE GENERAL MANAGER'S ACTIONS UNDER PUBLIC CONTRACT CODE 22050 TO DIRECT CASE /COTTER, INC.; D. W. NICHOLSON CORP.; AND DISTRICT FORCES TO PERFORM EMERGENCY REPAIRS ON A DAMAGED DISSOLVED AIR FLOTATION (DAF) TANK LOCATED IN THE DISTRICT'S TREATMENT PLANT DISTRICT PROJECT 7265 TREATMENT PLANT EQUIPMENT REPLACEMENT PROJECT Senior Engineer Craig Mizutani described DAF Tank No. 1 as one of three tanks used to thicken waste sludge from the activated sludge process, before the sludge is mixed with primary sludge and dewatered. He stated that, during the graveyard shift on April 19, operators noted that the DAF drive unit was turning but the collector arms were not. The next morning, the tank was drained, and it was found that all six collector arms were sheered off, and there was significant damage to the outer baffle and track, which was likely corroded. Polymer was introduced to the waste activated sludge feed to the remaining two DAF tanks. Book 62 — Page 205 CENTRAL CONTRA COSTA SANITARY DISTRICT Board Minutes of May 2, 2013 Mr. Mizutani stated that, on April 22, Steve Olson of Case /Cotter, Inc., the tank's manufacturer, inspected the tank and noted corrosion on the structural steel. He recommended repairing or replacing the six collector arms, repairing the beach and baffle, replacing the entire track, restoring the coating, and checking the other tanks for damage. Mr. Mizutani stated that these repairs will be split among three parties. District staff will cut out the existing track and modify the drive for the new clutch. Case /Cotter will supply the new collector arms, provide onsite startup assistance, and perform a torque test on the arms. D.W. Nicholson, a mechanical contractor, will install new arms, prepare the coating, and weld the baffle, track, and other components, as part of a change order to the existing Treatment Plant Piping Renovations Project. Future work will include inspection of DAF Tank Nos. 2 and 3 and coating the structural steel of Tank No. 1. Staff expects DAF Tank No. 1 to be back in operation by May 27, 2013. Mr. Mizutani explained that the situation is an emergency for a number of reasons. First, while procedures are in place for processing secondary sludge with only one DAF Tank, the District has never actually done this. Second, given that the other tanks are the same age, they should also be inspected for comparable damage. Third, the cost of using the polymer in place of the functioning DAF Tank No. 1 is high, at approximately $500 per day. Finally, the District is risking a violation to its National Pollutant Discharge Elimination System (NPDES) permit should the other DAF Tanks fail. Therefore, staff recommended that the Board vote to pursue repairs on an emergency basis, with the plan for Case /Cotter to supply parts, D.W. Nicholson to install them, and District staff to assist when possible. President Nejedly, who inspected the damaged tank in person, stated that there was virtually no visibility inside the tank, so the initial event could have happened long ago. He suggested that staff check the other two tanks for similarly worn edges and replace the wear points as needed, speculating that perhaps there was too much friction between the roller and track. Mr. Mizutani responded that the District has been making its own rollers for the last 8 to 10 years out of a less abrasive material, but the damage could have been caused by the old steel rollers. District Counsel Kent Alm reminded the Board that, should the emergency be declared, the Board will be asked on the agenda at every following meeting to reconfirm that the emergency work should continue, until the work is completed. He also stated that there is a legal basis for an emergency to be declared, adding that, due to construction this summer, another major piece of machinery will be out of operation, and, if another DAF Tank were to fail at the time, the result would be catastrophic. It was moved by President Nejedly and seconded by Member Causey to declare an emergency and ratify by 4 /5th vote the General Manager's actions under Public Contract Code 22050 to perform emergency repairs on a damaged DAF tank, District Project 7265, Treatment Plant Equipment Replacement project. REPORT OUT OF CLOSED SESSION District Labor Counsel Dan Clinton announced that the Board gave direction to the labor negotiators with regard to Item 9.a. 11.
