ISSUE: On April 30, 2013, five sealed bids were received and opened for the
construction of the Primary Treatment Renovations, District Project 7285. The Board of
Directors must award the contract or reject bids within 50 days of the bid opening.
Authorize the General Manager to execute the contract documents subject to
SUBMITTAL requirements.
RECOMMENDATION: Find that the project is exempt from the California
Environmental Quality Act (CEQA); award a construction contract to W. M. Lyles,
Company; authorize the General Manager to execute the Contract Documents subject
to favorable review of insurance certificates, bond submittals, appropriate Contractor
license, and any other required submittals (SUBMITTALS); authorize the General
Manager to execute an amendment to the Professional Engineering Services
Agreement with HDR Engineering, Inc.; and authorize an agreement with Complete
Project Solutions (CPS), Inc.
FINANCIAL IMPACTS: Approximately $14,947,000, including design, bid price,
contingency, and construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: Two of the four primary sedimentation tanks were constructed in the
mid 1960s and the final two tanks were constructed in the mid 1970s as part of the
Water Reclamation Plant, Stage 5A, Phase 1, Expansion Project. Most of the piping
and components in the primary treatment area are between 35 and 50 years old. Some
piping and process components are corroding, which requires maintenance, while
others are nearing the end of their respective service life.

RENOVATIONS, DISTRICT PROJECT NO. 7285
This project will renovate or replace the scum collection system and the water and air
pipelines at the primary sedimentation tanks. In addition, the project will include
renovation of concrete, hand railing, lighting, and electrical upgrades to the motor
control center that provides power to the primary treatment facilities.
The project will also include installation of a scum thickening unit on the third floor of the
Solids Conditioning Building, construction of a new grit handling facility, a PE pump
VFD and the upgrade of a PE pump. The project work areas are shown in
Attachment 1.
Optional bid items for a second PE pump and installation of baffles in primary tanks 1, 2
and 3 were included in the bid. Due to favorable pricing on these two items, staff
recommends that they be included in the project. The cost of the two optional items is
included in the $10,277,000 bid price.
Due to complexity of work, long equipment lead times, and wet - weather construction
restrictions, the project is expected to require approximately 28 months to complete.
HDR Engineering, Inc. and District staff prepared the plans and specifications for the
project. The Engineer's estimate for construction of the Primary Treatment
Renovations, District Project 7285, is $10,500,000. This project was advertised on
March 19 and April 2, 2013. Five sealed bids ranging from $10,277,000 to $12,580,000
were received and publicly opened on April 30, 2013.
The Engineering Department conducted a technical and commercial review of the bids
and determined that W. M. Lyles, Company is the lowest responsive bidder with a bid
amount of $10,277,000. A summary of bids received is shown in Attachment 2.
The District will perform construction management and will provide contract
administration, survey, office engineering, and submittal review.
The complex nature of the work requires special inspection to supplement District
inspection staff. RFPs for inspection services were provided to six companies.
Proposals were received from CPS and Harvest Technical Services, Inc. CPS was
selected because their inspectors are experienced and because they offered the lowest
hourly rates. An inspection services contract with a cost ceiling of $346,000 has been
negotiated with CPS.
Staff recommends retaining HDR Engineering, Inc. to provide support services during
construction for this project because HDR Engineering, Inc. helped prepare the plans

and specifications and, therefore, has a solid understanding of the project design. The
construction support services include reviewing shop drawings and submittals,
responding to design questions, evaluating change order requests, performing site visits
to verify compliance with the design intent, and other related activities. A construction
support services contract with a cost ceiling of $338,000 has been negotiated with HDR
Engineering, Inc. This will bring the total professional service contract with HDR
Engineering, Inc. to $1,165,000. The funds required to complete this project, as shown
in Attachment 3, are $13,087,000. The total cost of Primary Treatment Renovations,
District Project 7285, is anticipated to be $14,947,000.
This project is included in the fiscal year (FY) 2012 -13 Capital Improvement Budget
(CIB) on pages TP -44 and TP -45. Staff has conducted a cash -flow analysis of the
(FY) 2012 -13 and (FY) 2013 -14 Treatment Plant Program budget and concluded that
adequate funds are available for this project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15301, since it involves
minor alterations to existing public facilities involving no expansion of use, and District
CEQA Guidelines Section 15302, since it involves replacement of existing public
facilities at the same location and with the same purpose. Approval of this project will
establish the Board of Directors' independent finding that this project is exempt from
CEQA.
RECOMMENDED BOARD ACTION: Staff recommends the following:
Find that the project is exempt from CEQA,
2. Award a construction contract in the amount of $10,277,000 for the construction
of the Primary Treatment Renovations, District Project 7285, to W. M. Lyles,
Company, the lowest responsive bidder,
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements,
4. Authorize the General Manager to execute an amendment to an existing
professional service agreement not to exceed $338,000 with HDR Engineering,
Inc. to review shop drawings and submittals, respond to design questions,
evaluate change order requests, and perform site visits to verify compliance with
the design intent, and
