Submitted BY Initiating Dept. /Div.:

REVIEWED AND RECOMMENDED FOR BOARD ACTION:

S. Mestetsky - Senior Engineer C. Swanson
A. Antkowiak - Capital Project Division Manager / Provisional General Manager
ISSUE: Board approval of the Diablo Sewer Renovations, Phase 2, District
Project 5976, is required prior to the filing of a Notice of Exemption under the District's
California Environmental Quality Act (CEQA) Guidelines.
RECOMMENDATION: Approve the Diablo Sewer Renovations, Phase 2, District
Project 5976, for CEQA/Permitting purposes.
FINANCIAL IMPACTS: The total project cost is anticipated to be $2,500,000; however,
this position paper only approves the project for CEQA/Permitting purposes and does
not award a construction contract.
ALTERNATIVEStCONSIDERATIONS: The Board of Directors may delay or decline to
approve the project, which is not recommended.
BACKGROUND: The project is the second phase of renovations anticipated in Diablo,
CA. The Diablo Sewer Renovations, Phase 2 project will renovate and /or replace
approximately 11,800 feet of 6 -, 8 -, 10 -, and 12 -inch sewer lines in Danville and Diablo.
The project is scheduled for construction in fiscal year (FY) 2013 -2014.
The improvements to the Diablo Sewer Renovations, Phase 2 project are included in
the FY 2012 -2013 Capital Improvement Budget (CIB) on page CS -13. Staff has
conducted a cash -flow analysis of the Capital Improvement Program budget and
concluded that adequate funds are available for this project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15302, because it involves
replacement of existing sewer facilities at substantially the same locations and with the
same purpose and level of activity as the facilities being replaced. Any capacity
increases are for non - growth inducing, wet weather, or maintenance purposes. This

project also is exempt under District CEQA Guidelines Section 15061(b)(3), since it can
be seen with certainty that there is no possibility that the activity in question may have a
significant effect on the environment. This certainty is based on the District's past
experience with numerous sewer construction projects of this nature, the relatively short
distances involved, and the District's mitigating construction specifications. These
specifications are standardized general and special conditions that are made part of the
project bid documents to address environmental considerations, such as protecting
trees and riparian areas, as well as compliance with applicable federal, state, county,
district, municipal and local laws, ordinances, orders, and regulations. Approval of this
project will establish the Board of Directors' independent finding that this project is
exempt from CEQA.
RECOMMENDED BOARD ACTION: Approve the Diablo Sewer Renovations, Phase 2,
District Project 5976, and direct staff to file a Notice of Exemption with the Contra Costa
County Clerk.
