ISSUE: Board authorization is required for a leave of absence without pay in excess of
30 days.
RECOMMENDATION: Authorize military duty leave of absence without pay for Todd
Riley, Plant Operator I. This leave without pay will start on April 2, 2013, and his
anticipated return to work date is June 27, 2013.
FINANCIAL IMPACTS: The District would only be paying Mr. Riley's benefits resulting
in an approximate monthly cost of $857.
ALTERNATIVES /CONSIDERATIONS: At this time, there are no other alternatives as
the California Military and Veterans Code Section 395 seq., mandates that an employer
must grant a member of the National Guard a leave of absence of up to 180 days.
BACKGROUND: Mr. Riley has been called to serve in his role with the National Guard
and this assignment is anticipated to result in leave without pay in excess of 30 days.
Since the General Manager can only authorize leave without pay up to 30 days, Board
authorization is required.
The District's Military Leave Policy provides that "Employees who are assigned to
military duty are entitled to military leave in accordance with the provisions of applicable
state laws (California Military and Veterans Code Section 395 seq.).
RECOMMENDED BOARD ACTION: Authorize military duty leave of absence without
pay for Todd Riley, Plant Operator I. This leave without pay will start on April 2, 2013,
and his anticipated return to work date is June 27, 2013.
