ADOPT A RESOLUTION ACCEPTING A GRANT OF EASEMENT FROM 3977 S PEARDALE ASSOCIATES, A CALIFORNIA LIMITED PARTNERSHIP (DISTRICT PROJECT 8404 — PARCEL 8) AT 3977 S PEARDALE DRIVE LOCATED IN LAFAYETTE (APN: 248 - 051 -014) AND AUTHORIZING STAFF TO RECORD THE GRANT OF EASEMENT Submitted By: Initiating Dept. /Div.: Kathleen West, Senior Right of Way Agent Engineering /Environmental Services REVIEWED AND RECOMMENDED FOR BOARD ACTION: T. Swanson Provisional General Manager ISSUE: A resolution of the Board of Directors is required to accept and record a grant of easement. RECOMMENDATION: Adopt a resolution accepting a grant of easement and authorize staff to record the documents with the Contra Costa County Recorder. FINANCIAL IMPACTS: $2,000 will be paid for a permanent easement at 3977 S Peardale Drive for the Lafayette Sewer Renovations Project, Phase 8 (DP8404). $600 was paid for a temporary construction easement. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: Construction of the Lafayette Sewer Renovations Project, Phase 8 (District Project 8404) will not begin until spring 2013. There are a total of four permanent easements being acquired for the project. The property owner at 3977 S Peardale Drive is a developer who recently sold the property, it is currently in escrow and due to close by March 29, 2013. The developer has requested that the Grant of Easement be signed and recorded prior to the close of escrow. RECOMMENDED BOARD ACTION: Adopt a resolution accepting a grant of easement from 3977 S Peardale Associates, a California limited partnership, owners at 3977 S Peardale Drive in Lafayette (District Project 8404 — Parcel 8). Attachments: 1 — Proposed Resolution C:\ Users \danderson\NppData \Local \Microsoft \Windows \Temporary Internet Files \Content.Outlook \DVCG8C5G \PP GOE 3977 S Peardale Dr 3 -21 -13 Final (2).doc RESOLUTION NO. 2013- A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT AUTHORIZING EXECUTION AND RECORDING OF A GRANT OF EASEMENT TO 3977 S PEARDALE ASSOCIATES, A CALIFORNIA LIMITED PARTNERSHIP, PROPERTY OWNERS AT 3977 S PEARDALE DRIVE, LAFAYATTE APN 248 - 051 -014 (DP8404 — PARCEL 8) BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District (District) as follows: THAT the District hereby consents to the execution the Grant of Easement to 3977 S Peardale Associates, a California limited partnership, property owner of 3977 S Peardale Drive in Lafayette (APN 248 - 051 -014), Parcel 8; and THAT the President of the Board of Directors and the Secretary of the District are hereby authorized to execute said deed for and on behalf of the District; and THAT staff is authorized to record said deed in the office of the Recorder of Contra Costa County.
