ISSUE: On February 20, 2013, ten (10) sealed bids were received and opened for the
construction of the Concord Landscape Project, District Project 7299. The Board of
Directors must award the contract or reject bids within 50 days of the bid opening.
Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements. Board authorization is required for the General Manager to
execute agreements beyond staff's authority.
RECOMMENDATION: Award a construction contract; authorize the General Manager
to execute the Contract Documents subject to favorable review of insurance certificates,
bond submittals, appropriate Contractor license, and any other required submittals
(SUBMITTALS); authorize the General Manager to execute a Right -of -Entry (ROE)
Agreement with Buchanan Fields Golf Course, Inc.; authorize the General Manager to
execute an agreement amendment with Carollo Engineers, Inc. for engineering and
construction support services during construction.
FINANCIAL IMPACTS: Approximately $3,915,000, including design, bid price,
contingency, engineering services during construction, labor compliance program as
required per state grant requirements, payment of anticipated costs for golf course
restoration and lost profits of operation, and construction management. An additional
$500,000 will be requested later to complete individual customer connections, which
are not part of this project. To offset the financial impacts the District applied for and
has been awarded a $1,030,000 Proposition 84 Implementation Grant from the State
Department of Water Resources. Grant disbursements to the District will be made

upon submission of invoices and other required documentation. Staff is also seeking
federal legislative authorization and appropriation for up to an additional $1.8 million in
Title XVI funding for the project. Title XVI grant funds can be used to pay for expenses
already incurred and would apply retroactively to this project.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: In 2006, the District conducted an extensive design consultant
selection process for the A -Line Relief Interceptor and extension of the reclaimed water
main to the Diamond Boulevard commercial area. Consultants were invited to submit
Statements of Qualification (SOQ) for the project, and four SOQs were received. The
three most qualified consultants, Montgomery Watson Harza, Brown and Caldwell, and
Carollo Engineers, Inc., were sent Requests for Proposals (RFPs). After review of the
proposals and consultant interviews Carollo Engineers, Inc. was selected to design the
project. During design the recycled water portion was removed from the contract when
unanticipated requirements for backflow prevention devices from Contra Costa Water
District (CCWD) increased the project cost beyond what was budgeted. The recycled
water project consists of installation of approximately 12,100 linear feet of new recycled
water pipe. Attachment 1 shows the location of the project work.
At its March 19, 2009 meeting, the Board independently found that this project is
exempt from the California Environmental Quality Act (CEQA) under District CEQA
Guidelines Section 15061(b)(3). A Notice of Exemption was filed with the Contra Costa
County Clerk. At its December 8, 2011 meeting, the Board authorized the General
Manager to execute an agreement with Carollo Engineers, Inc. to complete the design
of the recycled water pipe originally begun in 2006. On December 20, 2011, the United
States Bureau of Reclamation determined that the project is in compliance with the
National Environmental Policy Act (NEPA) and approved a Finding of No Significant
Impact (FONSI). With NEPA requirements now complete, the District will be able to
receive federal grant funding for the construction phase of this project if it becomes
available in the future.
To satisfy requirements of California Safe Drinking Water, Water Quality and Supply,
Flood Control, and River and Coastal Protection Bond Act of 2006 (Proposition 84), at
its April 19, 2012 meeting, the Board adopted a resolution to adopt the Labor
Compliance Program (LCP), approved Contractor Compliance and Monitoring, Inc.

(CCMI) as the third party LCP administrator, and authorized staff and CCMI to submit
all necessary labor compliance program forms, applications, and information to the
Department of Industrial Relations (DIR) for this project.
At its July 19, 2012 meeting, the Board adopted a resolution accepting the terms of the
Proposition 84 grant for this project and authorized the General Manager to execute the
grant Implementation Agreement with the Bay Area Clean Water Agencies.
Subsequent to this Board action the agreement was executed.
Carollo Engineers, Inc. and District staff prepared the plans and specifications for the
project. The Engineer's estimate for construction of the Concord Landscape Project,
DP 7299, is $3,700,000. This project was advertised on January 14 and 22, 2013. Ten
(10) sealed bids ranging from $2,150,351 to $3,434,696 were received and publicly
opened on February 20, 2013.
The Engineering Department conducted a technical and commercial review of the bids
and determined that Platinum Pipeline, Inc. is the lowest responsive bidder with a bid
amount of $2,150,351. A summary of bids received is shown in Attachment 2.
The District will oversee administration of the construction contract. Staff recommends
retaining Carollo Engineers, Inc. to provide construction support for this project. Carollo
Engineers, Inc. prepared the plans and specifications, and has a unique understanding
of this project. Also, because of the unique nature of this project related to recycled
water pressure distribution pipeline installation, staff is recommending retaining a
construction management firm to assist with inspection and office engineering. Staff
solicited an RFP from five (5) construction management firms. Carollo Engineers, Inc.
was selected based on a combination of experience and price.
The construction support services will include reviewing shop drawings and submittals,
responding to design questions, evaluating change order requests, performing site visits
to verify compliance with the design intent, inspection, coordination of survey and field
testing, and other related activities. A construction support services contract with a cost
ceiling of $325,000 has been negotiated with Carollo Engineers, Inc. This will bring the
total professional service contract with Carollo Engineers, Inc. to $545,000.

Based on the actual costs during the A -Line Relief Interceptor project in the Buchanan
Field Golf Course (BFGC) for restoration work and lost profit, staff has estimated that
costs for these two items will be $119,000 and $43,000, respectively, for a total of
$162,000. Actual cost for the restoration work will be determined after the contractor
has moved off site. Actual cost for lost profits will be based on lost profit analyses
performed by two firms, one hired by the District, one hired by BFGC.
Although the recycled water main, services, and meter boxes will be installed with this
project, no recycled water meters will be placed. The conversion work from potable
water (CCWD) to recycled water (CCCSD) for irrigation purposes will occur with a
subsequent construction contract. The projected costs for the irrigation conversion
design, construction work, regulatory coordination, and installation of double -check
valve assemblies on fire services as required by CCWD is $500,000. Staff will return to
the Board to request authorizing this conversion construction work.
The funds required to complete this project, as shown in Attachment 3, are $3,253,000.
The total cost of the Concord Landscape Project, DP 7299, is anticipated to be
$3,915,000. The costs of completion of individual connections, estimated at $500,000,
are not included.
This project is included in the fiscal year (FY) 2012 -13 Capital Improvement Budget
(CIB) on pages RW -3. Staff has conducted a cash -flow analysis of the Recycled Water
Program budget and concluded that adequate funds are available for this project.
RECOMMENDED BOARD ACTION: Staff recommends the following:
Award a construction contract in the amount of $2,150,351 for the construction of
the Concord Landscape Project, District Project 7299, to Platinum Pipeline, Inc.,
the lowest responsive bidder;
2. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements;
3. Authorize the General Manager to execute a Right -of -Entry Agreement with
Buchanan Fields Golf Course, Inc.; and
