Swanson Provisional General Manager ISSUE: On Tuesday, January 29, 2013, one sealed bid was received and opened for the construction of the Fire Protection System Improvements, District Project 7283. The Board of Directors must award the contract or reject bids within 50 days of the bid opening. Authorize the General Manager to execute the contract documents subject to SUBMITTAL requirements. RECOMMENDATION: Find that the project is exempt from the California Environmental Quality Act (CEQA), award a construction contract, and authorize the General Manager to execute the Contract Documents subject to favorable review of insurance certificates, bond submittals, appropriate Contractor license, and any other required submittals (SUBMITTALS). FINANCIAL IMPACTS: Approximately $318,000, including design, bid price, contingency, and construction management. ALTERNATIVES /CONSIDERATIONS: Reject the bid, which is not recommended. BACKGROUND: The District's existing fire protection system is comprised of many independent fire protection and alarm systems that have been installed over a 40 -year period; many of the systems no longer meet fire code. This project will bring the HOB building up to current fire standards and address a variety of fire system issues located throughout the plant site. Construction in HOB will be concurrent with the Seismic Improvements. The Engineer's estimate for construction of Fire Protection System Improvements is $185,000. The project was advertised on January 7 and 17, 2013. One sealed bid, priced at $165,000, was received and publicly opened on January 29, 2013. The Engineering Department conducted a technical and commercial review of the bids and determined that FE Controls Corporation is the lowest responsive bidder with a bid amount of $165,000. A summary of bids received is shown in Attachment 2. The District will administer the construction contract and will provide contract administration, inspection and office engineering. HYT Corporation will provide submittal review and construction support. The funds required to complete this project, as shown in Attachment 3, are $233,000. The total cost of Fire Protection System Improvements is anticipated to be $318,000. This project is included in the fiscal year (FY) 2012 -13 Capital Improvement Budget (CIB) on pages TP -11. Staff has conducted a cash -flow analysis of the Treatment Plant Program budget and concluded that adequate funds are available for this project. Staff has concluded that this project is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines, Section 15301 since it involves minor alterations to an existing public facility involving negligible or no expansion of use. Authorization of the construction contract for this project will establish the Board of Directors' independent finding that the project is exempt from CEQA. RECOMMENDED BOARD ACTION: Staff recommends the following: 1. Find that the project is exempt from CEQA, 2. Award a construction contract in the amount of $165,000 for the construction of the Fire Protection System Improvements, District Project 7283, to FE Controls Corporation, the lowest responsive bidder, and 3. Authorize the General Manager to execute the Contract Documents subject to SUBMITTAL requirements.
