Secure services of arbitrator for Step Four Grievance of David RolleyCentral Contra Costa Sanitary District ' BOARD OF DIRECTORS • POSITION PAPER Board Meeting Date: January 24, 2013 Subject: DIRECT STAFF TO SECURE THE SERVICES OF AN ARBITRATOR IN ACCORDANCE WITH THE DISTRICT'S STEP FOUR GRIEVANCE PROCEDURE Submitted By: Teji O'Malley Initiating Dept. /Div.: Human Resources REVIEWED AND RECOMMENDED FOR BOARD ACTION: 1() ISSUE: When a grievance has been appealed to the Board level, the Board must employ a neutral third party to hear the matter and recommend action to the Board in accordance with the Memorandum of Understanding (MOU) between the District and the CCCSD Employee's Association, Public Employees' Union, Local One, Article III, Section 2.5. RECOMMENDATION: Direct staff to secure the services of an arbitrator in accordance with the District's grievance procedures. FINANCIAL IMPACTS: The District and Union share the cost of the arbitrator and court reporter for grievances. An estimated cost of these services is $3,000 per day, or $1500 per party. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: Accounting Technician III David Rolley has filed a grievance against the District concerning a Discussion Record entered into his Personnel File. General Manager Ann Farrell appointed Director of CSO Curt Swanson to be the Step Three Hearing Officer. Mr. Swanson held the hearing on December 10, 2012 and allowed the parties to submit additional documentation. After careful evaluation of the information presented at the hearing, Mr. Swanson denied the grievance. The Union has filed a Step Four grievance on Mr. Rolley's behalf.
