Penny D. Gemmell # M-40 Ann E. Farrell General Manager ISSUE: A resolution of the Board of Directors is required to execute quitclaim deeds and record them. RECOMMENDATION: Adopt a resolution authorizing the President of the Board of Directors and the Secretary of the District to execute Quitclaim Deeds for two abandoned sewer easements to Sufism Reoriented, owner of 11 White Horse Court, Walnut Creek (APN: 184 - 450 -037; Job 1552) and authorizing staff to record the documents with the county recorder. FINANCIAL IMPACTS: None. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: In December 1950 a non - exclusive five -foot wide easement was acquired by the District for a public sewer main in the northwestern portion of 11 White House Court, Walnut Creek. In July 1974, an exclusive ten -foot wide easement was acquired by the District for a public sewer main which affects the southern portion of 11 White Horse Court, Walnut Creek. The District did not build a sewer in either easement. Sewer for the property is currently connected to a third easement to the public main on Warren Road. The property owners have requested that the District now quitclaim the two unused easements to clear title on their parcel. Staff believes these easements are no longer of use to the District and recommends quitclaiming the District's interest in the sanitary sewer easements.
