Farrell General Manager ISSUE: Board of Directors' approval is required when establishing new classifications as well as adding and filling positions. RECOMMENDATION: Establish the Regulatory Compliance Division Manager classification (M24, $11,087 - $13,476), add a Regulatory Compliance Division Manager position and authorize filling the position. FINANCIAL IMPACTS: Upon approval, this action will result in a maximum annual net cost of $305,635 which takes into account salary, benefits, and pension costs at the maximum step of the salary range. However, the cost of this action will be completely offset and in fact, results in a cost savings, when this action is combined with the other actions that were taken as a result of the management reorganization. ALTERNATIVES /CONSIDERATIONS: Do not establish the classification or authorize the filling of the position. If this action is not approved, the District's ability to effectively coordinate regulatory compliance activities will be reduced. BACKGROUND: As a result of the flattening of the organization and the elimination of the Director of Plant Operations, it has been determined that there is a need to establish a new classification that will be responsible for the Laboratory and regulatory compliance programs and activities. Consolidating regulatory tracking and compliance in one Division under this classification will allow for the better coordination of regulatory compliance activities allow the District to engage in higher level regulatory advocacy efforts which are both critical functions of the District. This position would oversee the Laboratory, Environmental Compliance /Source Control, Household Hazardous Waste, Pollution Prevention and Regulatory Compliance as well as other similar related areas. This action was recommended for approval by the Human Resources Committee at its October 30, 2012 meeting. It was held over from the Board meeting on November 15, 2012 to allow Board Member McGill to participate in the vote. RECOMMENDED BOARD ACTION: Establish the Regulatory Compliance Division Manager classification (M24, $11,087 - $13,476), add a Regulatory Compliance Division Manager position and authorize filling the position. CENTRAL CONTRA COSTA SANITARY DISTRICT Effective: 12/6/12 Range: M -24 Respirator Class: 3 REGULATORY COMPLIANCE DIVISION MANAGER DEFINITION Plan, organize, direct, and review the operations of the District's Regulatory Compliance Division which includes the management and oversight of the Laboratory, Source Control, Household Hazardous Waste, Pollution Prevention Sections, and other areas requiring stringent regulatory compliance; and performs other related duties as assigned. DISTINGUISHING CHARACTERISTICS This class is distinguished from the General Manager in that the latter has full responsibility for all District related functions and activities. This class is distinguished from the Environmental Services Division Manager in that the latter has responsibility for Development Services, Right -of -Way, Survey, and long range planning and is further distinguished from the Capital Projects Division Manager in that the latter is responsible for coordinating with all departments and divisions in the development, design, and construction of District capital projects. SUPERVISION RECEIVED AND EXERCISED Receive administrative direction from the General Manager. Exercise direct and general supervision over assigned professional and technical personnel in the Regulatory Compliance Division EXAMPLES OF ESSENTIAL DUTIES - Duties may include, but are not limited to, the following: Manage the development and implementation of Division goals, objectives, and priorities. Oversee and ensure District activities and operations are in compliance with applicable Federal, State, and local laws, statutes, regulations, and policies. CENTRAL CONTRA COSTA SANITARY DISTRICT Regulatory Compliance Division Manager (Continued) Evaluate the effectiveness of regulatory compliance programs and develop and implement new programs as mandated by legislation and /or policy. Identify Division wide training needs and develop training plans. Select, train, evaluate, and monitor the performance of Division personnel, directly or through subordinate staff. Represent the District before boards, political bodies, committees, and the general public. Receive and interpret laboratory data from wastewater and environmental samples and apply results to regulatory requirements. Prepare reports and recommendations for the Board of Directors. Participate in various conferences /training in order to maintain awareness of new trends and developments related to regulatory compliance for assigned areas of responsibility. Monitor and analyze legislation and regulations that impact regulatory compliance and develop and implement programs that ensure District compliance. Oversee the preparation and submission of statistical and analytical reports to regulatory agencies such as the San Francisco Regional Water Quality Control Board and the Bay Area Air Quality Management District. Consult with General Manager in formulating District policy as it relates to regulatory compliance. Monitor and evaluate the efficiency and effectiveness of service delivery methods and procedures. Develop and oversee the Division's budget which includes forecasting of funds needed for staffing, equipment, and supplies and monitoring and approving expenditures. Provide comprehensive direction and support to all District programs regarding future, pending, and existing regulatory compliance issues. Negotiate and administer contracts for a variety of routine and complex consulting projects which includes monitoring and reviewing progress and scheduling and approving progress payments. 2 CENTRAL CONTRA COSTA SANITARY DISTRICT Regulatory Compliance Division Manager (Continued) Perform related duties as required. MINIMUM QUALIFICATIONS Knowledge of: Applicable federal, state, and local laws and regulations as they relate to regulatory compliance for assigned areas of responsibility. Principles and practices of budget preparation and administration. Principles and operational characteristics of a waste water agency. Principles and practices of program development and management. Legislative process of local, State, and Federal government. Regulatory agency functions and processes. Principles and practices of management and supervision. Principles and practices of wastewater collection, treatment, and discharge. Practices and techniques related to the conduct of environmental investigations and studies. Methods of microbiological and bacteriological test as related to wastewater. Safety precautions as required by the District, including but not limited to, Cal /OSHA General Industry Safety Orders, Districts Respiratory Protection Program, and District Safety Directives. Ability to: Develop and implement Division wide goals and objectives. Interpret applicable federal, state, and local laws and regulations as they relate to regulatory compliance. Plan and organize the work of subordinate personnel. 3 CENTRAL CONTRA COSTA SANITARY DISTRICT Regulatory Compliance Division Manager (Continued) Work effectively and cooperatively with representatives from other local, state, and federal regulatory agencies and programs as well as Division staff and the general public. Communicate effectively, both orally and in writing. Prepare or direct the preparation of comprehensive studies and reports. Understand, interpret, and explain complex laws and regulations. Oversee a comprehensive monitoring and reporting program related to areas of assigned responsibility. Make effective written, graphic, and oral presentations of complex and highly technical information. Prepare clear and concise administrative and financial reports. Analyze technical reports and data. Collect data, establish facts, and draw valid conclusions. Intermittently sit at desk, walk, stand, bend, squat, kneel, and twist during inspections; perform simple and power grasping, pushing, pulling and fine manipulation; lift or carry weight of 10 pounds or less; and occasionally lift or carry weight of 80 pounds or less. May be required to communicate via mobile communication device. Perform work under minimal supervision and within an environment of competing priorities and deadlines. Experience and Education: Any combination equivalent to experience and education that could likely provide the required knowledge and abilities would be qualifying. A typical way to obtain the knowledge and abilities would be: Experience 10 CENTRAL CONTRA COSTA SANITARY DISTRICT Regulatory Compliance Division Manager (Continued) Five years of experience monitoring and administering a regulatory compliance program which included overseeing some or all regulatory compliance related activities that would be required of a wastewater agency similar to the Districts. Education Equivalent to a bachelor's degree from an accredited college or university with a major in civil, environmental, or mechanical engineering; environmental science, biology, chemistry, business administration, or a closely related field. Substitution for Education Four years of additional qualifying experience as noted above may be substituted for the bachelor's degree. Licenses and Certificates: Possession of a valid California Driver's License. 5
