HomeMy WebLinkAbout06.a.1) Final report on easement amendment acquisitions along the Iron Horse Corridor (Handout)Item No. 6.a.1 Final Report Easement Amendments Along the Iron Horse Corridor Central Contra Costa Sanitary District, Contra Costa County, and Contra Costa County Redevelopment Agency Liz Charlton November 15, 2012 Central Contra Costa Sanitary District Iron Horse Corridor Easement Acquisition 1985-2012 W*#'00 - 0' - I) Handou� 1 Round 1 Proiect Background - 1985 • Prior to 1985, CCCSD installed its sewers in the Southern Pacific Railroad (SPRR) right -of -way under licenses. • With CCCSD's $5.4 million participation, the County was able to purchase the SPRR right -of -way (now the Iron Horse Corridor) in 1985. • In return, CCCSD received easements with very favorable rights from County and County Redevelopment Agency. The Grantor and the Grantee shall require all contractors or contractors assigns who shall undertake construction on any portion of the real property described in Exhibit One to list the other party as an additional insured on the contractor's project policy and further require the contractor to indemnify both parties in a like manner. 12. The scription of the easements contained herein are based on the best available information. When a more precise location of either existing or proposed pipelines have been determined by either field surveying or detailed engineering data the Grantor and the Grantee shall affect an adjustment (increase and /or decrease) to the easements provided for heroin in order to produce the final easement as intended by this conveyance. 13. The Grantor is proposing to grant a portion of its real property described as Parcel Nos. 17 through 29 to the Contra Costa County Flood Control District and Mater Conservation District for the construction, operation and maintenance of a flood control facility commonly referred to as the Walnut Creek By -Pass Pro.iect. The Round 2 4 2003 - San Ramon Forcemain • Dougherty Valley Settlement Agreement required construction of third San Ramon Forcemain in 2003. • Utility and trail improvements conflicted with original easements. • Over the District's protest, County staff insisted on easement terms that negated the District's prior rights. • Project timing did not allow resolution at that time. Round 3 ,t 5 2008 Board Actions • Authorized a program to amend the easements over 55 parcels covering 26 miles of interceptor sewer. • Authorized an agreement with BKF Engineers for survey work. • Authorized a MOU with the County and the Redevelopment Agency to amend locations of the original easements within the Iron Horse Corridor (IHC). 4 yP R.. 2006 2010 0 2011 2012 i I SPR /W AND ALINE - A-LINE RELIEF INTERCEPTOR - SPR /Y ,r., a .� " D Benefits of Amending Easements Enhanced protection of District facilities within Iron Horse Corridor (existing and future sewer locations): —Title search: Recorded easements will describe actual sewer locations or future alignment. — Field location: Real -time survey location, since descriptions tie to GPS monuments.
