Farrell District Counsel General Manager ISSUE: A Declaration of an Emergency by the Board is required for the General Manager to perform emergency repairs under Public Contract Code 22050(b). RECOMMENDATION: Declare an emergency and ratify the General Manager's actions under Public Contract Code 22050 to direct Ranger Pipelines to perform emergency repairs on a damaged sewer main at Barkley Avenue in Walnut Creek, District Project 4654. FINANCIAL IMPACTS: The cost of the repairs is estimated to be $25,000 to $30,000. There are sufficient funds in the contingency account of the Collection System Program of the Capital Improvement Budget (CIB) for these repairs. Allocation of this amount is within the authority of the General Manager. Damage to the sewer main was caused by a construction contractor for a residential development. Staff will seek reimbursement of the repair costs and emergency response costs from the contractor or developer. ALTERNATIVES /CONSIDERATIONS: None. BACKGROUND: On Saturday, November 4, 2012, the Collection System Operations (CSO) on -call crew responded to an overflow at Barkley Avenue and Ygnacio Valley Road West (near the BART Station) in Walnut Creek. The crew discovered sewage overflowing from a 10 -inch sewer. The crew attempted to clear the blockage, first with a power rodder and then a hydro truck. Both attempts resulted in cleaning tools becoming stuck in the sewer. Additional CSO staff was called to the scene to set up temporary bypass pumping around the damaged sewer, and clean up the overflow. The sewer blockage occurred at a property being developed with 10 townhouses by the Habitat for Humanity organization. CSO staff believed that a contractor for the housing project may have drilled through a 10 -inch sewer while pouring a concrete pier and wall foundation. DECLARE AN EMERGENCY AND RATIFY THE GENERAL MANAGER'S ACTIONS UNDER PUBLIC CONTRACT CODE 22050 TO DIRECT RANGER PIPELINES TO PERFORM EMERGENCY REPAIRS ON A DAMAGED SEWER MAIN AT BARKLEY AVENUE IN WALNUT CREEK, DISTRICT PROJECT 4654 CSO crews televised the sewer and verified that there was a hole in the top of the sewer directly beneath a concrete pier. The sewer was blocked by a large amount of gravel that had been placed at the bottom of the pier hole prior to pouring concrete. The sewer main is 15 to 18 feet deep, which requires that we use a pipeline contractor to perform emergency repairs of the damaged sewer. CSO and Engineering staff arranged for Ranger Pipelines, a contractor currently working on a District sewer renovation project, to repair the sewer. On November 6, 2012, Ranger Pipelines removed the concrete pier, and replaced the damaged section of sewer. The repair was completed on November 8, 2012. Ranger Pipelines performed the repair on a time and material basis. The estimated cost of the repairs is $25,000 to $30,000. Staff will advise the Board of the actual repair cost at the Board meeting. Funds for the repairs will come from the contingency account of the Collection System Program of the CIB. This fund authorization is within the authority limits of the General Manager. The District notified the appropriate state and local authorities about the overflow. There was no damage to private property as a result of the overflow. District staff will seek reimbursement of the overflow response and clean -up costs and the sewer repair costs from Habitat for Humanity and their contractors and engineers.
