ISSUE: The Architectural Paint Bill — AB 1343 (Huffman) was implemented in July
2012. It requires paint manufacturers to develop and implement recovery programs for
the collection, transportation, processing, and disposal of waste architectural paints
collected in California. In order to take advantage of this free program, the District must
enter into an agreement that allows PaintCare (the paint industry's nonprofit) to manage
the architectural paints collected by the Household Hazardous Waste (HHW) Collection
Program.
RECOMMENDATION: Authorize the General Manager to execute an agreement that
allows PaintCare to transport, recycle and dispose of architectural paints collected by
the HHW Program at no cost to the District.
FINANCIAL IMPACTS: Approximately $330,000 in labor, disposal and material costs
will be saved annually by participating in the PaintCare Program. This savings is about
15% of the FY 2011 -12 HHW Program operating expenses.
ALTERNATIVES /CONSIDERATIONS: The District is not obligated by AB 1343 to
participate in the PaintCare Program. The Board could choose not to pursue an
agreement with PaintCare and continue to pay the transportation and disposal costs for
paint management, however this is not recommended considering the significant cost
savings from participating in the program.
BACKGROUND: AB 1343 requires paint manufacturers to reduce the generation of
post- consumer paint, promote its proper use and reuse, and manage the paint's end -of-
life. PaintCare, the non - profit organization representing paint manufacturers, is
responsible for educating the public on proper paint handling, storage, use and
disposal, and for transportation and disposal of paint collected by the program.

Over 55% of the waste collected by the District's HHW Program is paint that falls under
the PaintCare Program. PaintCare will pay the cost of transportation and disposal of all
program paint. Staff has estimated that the PaintCare Program will save the District
approximately $330,000 in labor, disposal and material costs annually. This savings is
about 15% of the FY 2011 -12 HHW Program operating expenses.
Staff has been working with District Counsel and PaintCare to negotiate an acceptable
agreement that meets the insurance and indemnification requirements of the District. It
has been determined that the District's own pollution insurance policy covers third party
transportation of waste up to $5 million, and also provides blanket coverage for non -
owned disposal sites up to $10 million. Thus, the District's policy will allow the District
to participate in the PaintCare Program without taking on additional liability.
Staff discussed the PaintCare Program with the Board HHW Committee at its October
8, 2012 meeting. The Committee agreed that the PaintCare Program would be
beneficial to the District, and concurs with staff's recommendation to proceed with
negotiating and executing an agreement with PaintCare.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
agreement with PaintCare to transport, recycle and dispose of architectural paints
collected by the HHW Collection Program.
