ISSUE: The Board must conduct a public hearing to declare land as un- needed and
authorize staff to execute lease agreements.

RECOMMENDATION: Set December 20, 2012 at 2:00 p.m. as the date and time for a
public hearing to consider declaring the Kiewit Property (APN 159 - 140 -051) as currently
un- needed, and authorizing the General Manager or her designee to amend the current
lease with County Quarry Products LLC (County Quarry) for an extended term of less
than ten years.
FINANCIAL IMPACTS: None by this action. If, after conducting the public hearing, the
Board authorizes extension of the lease, County Quarry will continue to share in cost
and revenue during final grading and closure of the clean fill operation.
ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the
recommended public hearing date or may elect to choose a different date; however, a
public hearing must be held and the property must be declared as "currently un-
needed" if the lease is to be extended.
BACKGROUND: The District leased its Kiewit Property parcel for a clean fill operation
to obtain revenue and prepare the site for other industrial use. This site (see
Attachment 1 for a site map) is approximately 33 acres and located between Grayson
and Walnut Creeks, Highway 4, and Imhoff Drive adjacent to the District's wastewater
treatment plant in Martinez, California. The vacant property is owned by the District and
used as a buffer zone for the treatment plant. The current project provides for filling the
site with clean fill to match the top -of -curb elevation on the south side of Imhoff Drive.
The design final grade of the site will be about five feet above its pre - project elevation.
County Quarry, a private lessee /clean fill site operator, was selected by the District to
design the project, obtain permits, and operate the project over its expected five -year
life.

The impact of the slow economy on the fill operation has prevented its completion at
the pace originally anticipated. The lease was extended by one year to December 31,
2012. The continued slow economy has prevented the project's completionin 2012.
The site is nearly full and an extension is needed to complete the fill operation and
perform final grading by June 30, 2013.
RECOMMENDED BOARD ACTION: Set December 20, 2012 at 2:00 p.m. as the date
and time for a public hearing to consider declaring the Kiewit Property (APN 159 -140-
051) as currently un- needed, and authorizing the General Manager or her designee to
amend the current lease with County Quarry for an extended term of less than ten
years.
