PERIOD FROM SEPTEMBER 30, 2012 THROUGH DECEMBER 31, 2012, AND
MONTH -TO -MONTH THEREAFTER AS NECESSARY UNTIL FURTHER BOARD

ISSUE: The contract extension for legal services with Kenton L. Alm and Meyers,
Nave, Riback, Silver & Wilson requires approval by the Board of Directors. The current
contract expires on September 30, 2012. An Ad Hoc Committee has been established
to review District legal services and will make a recommendation to the full Board.
RECOMMENDATION: Approve the contract extension through December 31, 2012
with Kenton L. Alm and Meyers, Nave, Riback, Silver & Wilson for legal services, with
the provision that the contract will then extend on a month -to -month basis if necessary
at that time until further Board action.
FINANCIAL IMPACTS: No rate increase is proposed in the extension.
ALTERNATIVES /CONSIDERATIONS: The Board could elect not to extend the
contract for legal services. This is not recommended.
BACKGROUND: The District has been receiving general legal services and Counsel
for the District services from Mr. Kenton L. Alm of Meyers, Nave, Riback, Silver and
Wilson since 1985 by a contractual arrangement. The term of the current contract
expires on September 30, 2012.
At its meeting of September 6, 2012, at the recommendation of the Human Resources
Committee, the Board established an Ad Hoc Committee to review and evaluate the
provision of legal services to the District. It is hoped that the Committee will make a
recommendation to the Board by the end of 2012, when both the extended contract
with Meyers Nave and the existing contract with Hanson Bridgett as District labor
counsel will expire. If the Ad Hoc Committee has not concluded its review by that time,
it is recommended that the contract extend on a month -to -month basis until further
Board action.
The proposed terms of the contract extension are unchanged from the current contract.
