Bernard Martinez has been promoted to Maintenance Technician III, Mechanical, in the
Plant Operations Department, effective July 30, 2012.
General Update
f) Delinquent Fees for Second Living Unit at 1800 San Luis Road in
Walnut Creek Paid in Full
At the July 19, 2012 meeting, the Board directed staff to record a certificate of unpaid
charges on this property. The certificate was recorded on July 24, and on July 26 the
property owner came to the Permit Counter to resolve the matter of the unpaid fees so
that escrow on a pending sale could close. Staff contacted the title company and
presented a demand for charges. On Monday, July 30, a check for the District's charges
was received from the title company. Staff will now record a release of the certificate.
If the certificate had not been recorded, it is possible that the District would not have been
able to collect these charges on the tax roll due to the likelihood that the sale would have
been concluded prior to the due date for the first installment of 2012 -13 property taxes.
Therefore, it is important to record a certificate of unpaid charges against the property to
secure the District's charges since it is always possible that a property might be sold after
unpaid charges are discovered but before the first installment of property taxes is due in
November.
At the September 6, 2012 Board meeting, staff will recommend adoption of a resolution
directing staff to (1) record certificates of unpaid charges whenever collection efforts are
initiated for delinquent fees or charges, and (2) record releases of said certificates upon
payment of all charges owed.
