ISSUE: A resolution of the Board of Directors is required to execute a quitclaim deed
and record it.
RECOMMENDATION: Authorize the President of the Board and the Secretary of the
District to execute a Quitclaim Deed and authorize staff to record the deed with the
Contra Costa County Recorder.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: None.
BACKGROUND: In September 1952, a non - exclusive 5' easement was acquired for a
public sewer main by Diablo Public Utility District, which affected the southerly portion
of 1733 Alameda Diablo, Diablo. The District abandoned this line as part of the Diablo
Phase 1 Renovations Project (DP 5953).
The property owners have requested that the District now quitclaim the old easement to
clear title on their parcel. The recommended Board action would quitclaim the District's
interest in the sanitary sewer easement since the line has been abandoned.
RECOMMENDED BOARD ACTION: Authorize the President of the Board of Directors
and the Secretary of the District to execute a Quitclaim Deed for an abandoned sewer
easement to Joseph E. and Susan D. Raphel, as Co- Trustees of the Joseph and Susan
Raphel Family Trust, owner of 1733 Alameda Diablo, Diablo (APN: 195 - 151 -001; Job
91).

A RESOLUTION AUTHORIZING EXECUTION AND RECORDING OF A
QUITCLAIM DEED
AT 1733 ALAMEDA DIABLO, DIABLO
(JOB 91)
BE IT RESOLVED by the Board of Directors of the Central Contra Costa Sanitary District
( "District ") as follows:
THAT the District hereby consents to the execution of a Quitclaim Deed to Joseph E. and
Susan D. Raphel, property owners of 1733 Alameda Diablo, Diablo (APN: 195 - 151 -001);
and
THAT the President of the Board of Directors and the Secretary of the District are hereby
authorized to execute said deed for and on behalf of the District; and
THAT staff is authorized to record said deed in the office of the Recorder of Contra Costa
County.
PASSED AND ADOPTED this 2nd day of August 2012, by the Board of Directors of the
