• Non - Participants' Cost Shares:
— District would cover up to 18 of the 35 shares (51%)
of the project cost for Scenario "B"
— Total amount could be as much as $476,000
Allow a 20 -year repayment period rather than the
current 10 -year provided in the CAD Policy

Request for Reconsideration
On June 7th, after receiving a request from a number of
property owners, the Board decided to reconsider the
exceptions. The property owners asserted that:
Notice to the affected community was insufficient;
District staff's Position Paper was factually incorrect and
incomplete;
— Project proponents have made unsubstantiated
assertions;
— The potential El Toyonal CAD is not similar to those in
Alhambra Valley;
— The approved exceptions subsidize a few well- funded
developers; and
— Many property owners oppose extension of public
sewer. ,�
Boundary Maps
Some opponents have asked why boundaries for potential
CADs change over time.
— Boundaries are drawn so that as many prospective
participating properties as possible can ultimately be
served by CAD sewers.
— District staff works with proponents to define potential
CAD project boundaries where it is likely that Proposition
218 balloting will result in successful CAD formation.
— Over time, as property owners indicate whether or not
they are willing to participate in a potential CAD, the
project limits and proposed boundaries are adjusted to
exclude blocks of properties at the periphery whose
owners decline to participate and include properties
whose owners plan to participate.

maintenance
— Minimizing impacts of construction on residents
— Special financing programs

responsibility of agencies other than the District:
- Land Development: City of Orinda
- Roads: City of Orinda / Homeowners Association
— Water Supply: EBMUD
— Fire Protection: Moraga Orinda Fire Protection District
— Septic Tank Moratorium: Contra Costa County

Impact of Potential CAD Policy
Exceptions
• The annual cost per participant for a $750,000 project
benefiting 20 parcels with 11 participants and nine non-
participants at 6% interest is:
— 10 years: Participants cover non - participants: $ 8,492 / yr
— 20 years; Participants cover non - participants: $ 5,449 / yr
— 10 years: CCCSD covers non - participants: $ 5,091 / yr
• Extending the payback period to 20 years accomplishes
a similar reduction in annual cost to District paying non-
participant costs.

Recommendations
Rescind approval of policy exception providing for
CCCSD to cover CAD non - participants' shares of
sewer extension costs.
Confirm approval of policy exception providing for a
20 -year repayment period for participants'
assessments.
