Thank you for sending the latest position paper and maps.
Yes, I do have one question, and some comments. Please note as follows:
Question: For the smaller CAD, will Robert Marino and the Liebers (each with 2 properties) be
assessed twice?
Comments:
The maps are incorrect again. Jill Tucker on El Toyonal is a most emphatic NO vote, but her
property lacks the *.
Every one of your maps has contained one or more errors in favor of the sewer. I have never found
one YES vote 'accidentally' referred to as a NO.
To reiterate, all the properties on El Toyonal and El Rincon are against the sewer.
You have the petition with all signatures and verbal confirmation from 301 El Toyonal.
The maps showing the errors will be sent via a separate email.
Your position paper contains the following statement in favor of upholding CAD Policy Exceptions:
"Existing septic tanks perform poorly due to the El Toyonal hill's clay soil and steep topography."
Please note: Clay soil is non - porous and has low permeability. This means the air spaces in the soil
are flat, and not fully interconnected. This slows down groundwater movement.
Steep topography speeds up groundwater movement. In essence, what you are stating is that the
"subsurface water moves too slow and it moves too fast."
So which is it? Do the two conditions counterbalance each other? If so, how?
More importantly, NO ONE has measured "the performance" of existing septic tanks.
You should not state they perform poorly without any data.
Providing a statement that is unsupported, speculative and self- contradictory tarnishes both your
reputation and the report.
On the other hand, one statement for rescinding the CAD policy Exceptions, is woefully incomplete.
You wrote: Many property owners with developed properties oppose the extension of a public sewer.
You left out...
"BECAUSE, large scale excavation activities in the past have resulted in landslides and lawsuits;
(FACT)
the Orinda fire chief has expressed concern of fire safety, if the area is developed without
corresponding upgrades to the fire hydrants (FACT)
and increased development will result in increased traffic;which increases the likelihood of accidents
on the single lane, narrow, winding roads. (Speculative, but reasonable).
Your website - on the Mission, Vision and Values page, states you will achieve your goals by valuing
Ethics and Integrity
Community relationships
Let me just point out that your zeal to install the sewer for the benefit of non - resident lot owners,
some of whom are long term friends of yours,
has apparently allowed you to compromise, ethics, integrity and the most certainly the relationships
with the residents of this community.
One of them asked me this morning if we could impose a "moratorium on sewers ".
Of course, this is not possible, but it should help you understand the level of community opposition
that has grown based on -
inaccurate maps, incomplete statements, vague generalities, and faulty, misleading logic on your
part.
Some of the proponents of the sewer have lied about leaking septic tanks, lied about watershed and
reservoir pollution, they threatened the district with violations of the Clean Water Act,
and they threatened members of our community (some of them quite elderly).
You could help heal this rift by providing accurate maps, and publish complete statements that are
supported by data..

Louise, et al:
At its meeting next Thursday, July 19, 2012 at 2:00 pm, the District's Board of Directors will
reconsider its May 17, 2012 action, which approved exceptions to the financing policy for a potential
CAD in the El Toyonal area. For your information, I've attached a copy of the staff report (Position
Paper) that is included in the Board Agenda Packet.
You will note that the staff recommendations presented in the Position Paper are:
1) Rescind approval of CAD Policy exception to pay non - participant cost shares for the potential
El Toyonal CAD.
2) Confirm approval of CAD Policy exception to extend the repayment period available for
participants' assessments from the ten years allowed in the CAD Policy to twenty years in
order to mitigate the high cost of sewering in the El Toyonal area.
