ISSUE: On July 9, 2012, eight sealed bids were received and opened for the
construction of the Seismic Improvements for Rental Property, District Project 8231.
The Board of Directors must award the contract or reject bids within 50 days of the bid
opening. Authorize the General Manager to execute the contract documents subject to
SUBMITTAL requirements.
RECOMMENDATION: Find that the project is exempt from the California
Environmental Quality Act (CEQA); waive non - material irregularity and award a
construction contract; and authorize the General Manager to execute the Contract
Documents subject to favorable review of insurance certificates, bond submittals,
appropriate Contractor license, and any other required submittals (SUBMITTALS).
FINANCIAL IMPACTS: Approximately $371,290 including design, bid price,
contingency, and construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: Design of structures to withstand forces generated by earthquakes is
a field which continues to evolve each time there is a significant seismic event. After
each such event, structural engineers review the forces and resultant damages and
reanalyze current codes. As a result of the Northridge Earthquake in 1994, significant
changes were recommended for the then - current building codes. In January 2008,
California adopted updated building codes. Based on the knowledge that significant
changes in seismic codes had occurred, District staff determined that it would be
prudent to conduct a seismic analysis of District facilities. This seismic analysis has
been completed. The analysis identified significant deficiencies in many District
facilities, including the Rental Property located at 4737 Imhoff Place, Martinez, CA.

The Rental Property was constructed circa late 1970s. The building is a single -story,
high -bay concrete tilt -up structure with a re- entrant corner. A two -story wood frame
office building is attached to the concrete structure at the south west re- entrant corner.
See Attachment 1 for location of Rental Property.
District staff retained the services of a local, structural engineering firm to design a
retrofit to the Rental Property. The retrofit will not bring the property up to current, life -
safety standards, but addresses the major structural deficiencies of the property by
improving the continuity of the roof beams and the connections between the roof beams
and tilt -up panels. This retrofit will greatly enhance the ability of people to safely exit
the building in the event of a strong earthquake. The building is currently occupied by
District staff and tenants, and will house additional District staff during the HOB Seismic
Renovation Project.
HD Rueb Structural Engineer (HD Rueb) and District staff prepared the plans and
specifications for the project. The Engineer's estimate for construction of Seismic
Improvements for Rental Property is $233,000. This project was advertised on
June 18, 2012. Eight sealed bids, ranging from $186,800 to $244,722 were received
and publicly opened on July 9, 2012. The Engineering Department conducted a
technical and commercial review of the bids and determined that CF Contracting, Inc. is
the lowest responsive bidder with a bid amount of $186,800. This conclusion came
after staff, in consultation with District counsel, determined that CF Contracting, Inc.
had a defect in its bid that should be waived as immaterial; namely that CF Contracting,
Inc. failed to execute its "Statement of Experience" bid form. Since this bid defect does
not change the amount of the bid, nor alter in any material way the other terms of the
bid, the Board's approval of this contract will confirm staff's finding that this bid defect is
non - material, and is waived. A summary of bids received is shown in Attachment 2.
The District will perform construction management and will provide contract
administration, inspection, survey, office engineering, and submittal review.
Staff will retain HD Rueb to provide support services during construction for this project
because HD Rueb helped prepare the plans and specifications and, therefore, has a
solid understanding of the project design. The construction support services include
reviewing shop drawings and submittals, responding to design questions, evaluating
change order requests, performing site visits to verify compliance with the design intent,
and other related activities. The scope of construction support services has been
included in HD Rueb's design contract.

The funds required to complete this project, as shown in Attachment 3, are $306,290.
The total cost of Seismic Improvements for Rental Property is anticipated to be
$371,290.
This project is included in the fiscal year (FY) 2012 -2013 Capital Improvement Budget
(CIB) on pages GI -36 and GI -37. Staff has conducted a cash -flow analysis of the
General Improvement Program budget and concluded that adequate funds are
available for this project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15301 since it involves
repairs to existing public facilities involving no expansion of use. Approval of this
project will establish the Board of Directors' independent finding that this project is
exempt from CEQA.
RECOMMENDED BOARD ACTION: Staff recommends the following:
Find that the project is exempt from CEQA,
2. Waive non - material irregularity and award a construction contract in the amount
of $186,800 for the construction of the Seismic Improvements for Rental
Property, District Project 8231, to CF Contracting, Inc., the lowest responsive
bidder, and
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements
