Before I begin I would like to request that civility be upheld in the room. At our last meeting the opponents of the appeal were quite loud and disrespectful. 1. Proponents of the Sewer President Nejedly admonished us at the last meeting that compared to the residents of Alhambra Valley we were not working together. We took this to heart. My neighbor Louise and I tried to call the proponents of the sewer. Personally I had a very pleasant conversation with one gentleman, but it turned awkward when he offered me $100.000 to change my vote from no to a yes. All the other conversations were difficult to say the least, as we were yelled at and verbally abused. Other residents were also threatened. At the last meeting, the testimony of the proponents brought an emotional response from one of the board members expressing feelings of guilt that she was denying lot owners a chance to build a home for their families. Madam, all of the lot owners have homes, some quite lavish. At least two of the lot owners in their own words are not planning to build homes, but instead to sell their lots. The majority of these lots were bought very cheaply. The lot around the corner from my house was bought in1965 for $500. 1 wish I had been there! Others were bought at a time when prices were much higher in Orinda, yet they were bought for a song. I know of one that was purchased for $18,000. Why would precious real estate in Orinda be sold so cheaply? Because it was bought after the septic tank moratorium. Now some lot owners are speculating that by bringing the sewer up they will make a great deal of money while their neighbors subside their development. Well, I bought my house 14 years ago at the height of the market. I have a terrifically high mortgage, I pay high taxes and I am not willing to subsidize other people's speculations. 2. Purpose of the Assessment District and the Sewer Correct me if I am wrong, but my understanding is that the CAD program was designed to assist getting developed properties off septic tanks and onto sewers. That is why at least 60% of properties on a sewer route should be developed properties with residences. This is not the case. One of the gentlemen on the board at the last meeting was very concerned with the health of our community using septic systems. If the Sanitary District was indeed concerned with health, then one would expect the planned sewer route would be made available to as many houses as possible. In reality the sewer route is planned in such a way that it will pass as many undeveloped properties as possible while avoiding the developed properties because most of the homeowners are in known opposition to the sewer. In order to push this project through and against the will of the residents, the district has been gerrymandering the sewer route and the voting district. The route and the proposed district appear to be a moving target, seemingly changing at whim. 3. Prop 218 took a quick law course on the Internet and studied Proposition 218 in detail, including the comments and interpretations from the Legislative Analyst's Office. I would like to quote the first step required for an Assessment District to be established. First: Determine If a Project or Service Provides Special Benefits. The local government must determine whether property owners would receive a "special benefit" from the project or service to be financed by the assessment. Proposition 218 defines a "special benefit" as a particular benefit to land and buildings, not a general benefit to the public or a general increase in property values. By definition: A "special benefit" is a distinct benefit to real property in a specific area. All other benefits, including people's health, education or safety or general enhancements to property values are considered general benefits. If a project or service would not provide such a "special benefit," Proposition 218 states that it may not be financed by an assessment. The opponents of the CAD hereby state that by forming an assessment district and bringing the sewer to our properties, you are not providing a "special benefit" to our land or property. I would like to bring to your attention another part of Prop 218 which says, I quote: "(f) In any legal action contesting the validity of any assessment, the burden shall be on the agency to demonstrate that the property or properties in question receive a special benefit over and above the benefits conferred on the public at large and that the amount of any contested assessment is proportional to, and no greater than, the benefits conferred on the property or properties in question." 4. The True Amount of Support and Opposition This process has been marred by disinformation and a lack of honesty from the start. You board members have been misled by the inflated numbers of support. Some of the owners that you were told were in support, in fact never expressed that support. Once and for all I would like to present the true picture and the statistics, substantiated by the colored spread sheet, and the map that has been submitted to you. The map and the spreadsheet originate from your supervising engineer. There are 45 properties on the spreadsheet and the map. Out of those, there are 26 developed properties with houses and 19 undeveloped lots. Out of 26 developed properties 24 oppose the CAD and the sewer. That is every single resident. The two developed properties that are in support are either empty or rented. Out of 19 lot owners, 5 oppose the CAD. In all 29 oppose it. Furthermore, not a single property owner on El Toyonal - which is the proposed beginning of the sewer project - is supporting the sewer. Since you received a preliminary petition two weeks ago the CAD district has been changed to exclude the properties on upper Camino Monte and Via San Inigo. In this second option the proposed district has shrunk from 45 to 36 properties which is demarcated by a yellow line. In this new district, 21 property owners are opposed and 15 support it. I presume there will be a push for a third possible district marked by a blue line. In that district you have only 20 properties; 8 of those are undeveloped lots. Out of those 20 properties there are 10 owners in support and 10 opposed. Unless the rules have changed, one needs to earn 51 % of those voting to win. So in that scenario, even the smallest, truncated district is not viable. To assure you that this information is correct ,I am submitting today on behalf of the neighborhood property owners, a petition opposing the CAD with the signatures of all those in opposition. As Prop 218 Further Designates "(2) The agency shall conduct a public hearing upon the proposed fee or charge not less than 45 days after mailing the notice of the proposed fee or charge to the record owners of each identified parcel upon which the fee or charge is proposed for imposition. At the public hearing, the agency shall consider all protests against the proposed fee or charge. If written protests against the proposed fee or charge are presented by a majority of owners of the identified parcels, the agency shall not impose the fee or charge."
