Ann Farrell General Manager June 7, 2012 Central Contra Costa Sanitary District Request for Reconsideration Property owners opposed to extension of public sewer have requested that the Board reconsider its approval of the CAD Policy exception to pay for non - participants costs asserting that: — The approved exception for the District to fund the non - participants costs will inappropriately subsidize a few property owners (who can still fund a public sewer by using the traditional CAD process and themselves funding the non - participants costs.) — Notice to the affected community was insufficient; District staff's Position Paper did not accurately portray the amount of opposition; — Many property owners with developed properties oppose the extension of public sewer — The CAD program was designed to assist getting developed properties off septic tanks and onto sewers not to facilitate development of undeveloped properties. Staff Recommendation Reconsider CAD Policy Exceptions for a potential El Toyonal area CAD in Orinda — El Toyonal potential CAD does not meet criteria for 60% of tributary properties to have existing homes served by septic tank systems — 57% of the properties are developed — 49% of the properties have expressed an interest — Traditional CAD may not proceed because it requires 51 % approval of tributary properties — Action to subsidize development of properties by Enon - participant share may not be in District's best interest Calendar reconsideration for June 21, 2012 Board meeting The Board may decide to reconsider its May 17, 2012 approval of CAD Policy exceptions for the St. Mary's Road CAD \7ri Staff Recommendation • Do NOT reconsider CAD Policy Exceptions for St Mary's CAD in Lafayette — The project meets all CAD policy criteria — The City of Lafayette is partnering in paying some of the non - participants costs and has already taken to Council and passed budget — The project proponents are partnering in paying some of the non - participants costs — 92% of properties are developed and nine of ten submitting ballots approved of project. Return to Item 5.d. • Conduct a Public Hearing for St. Mary's CAD • Authorize agreement with parcel owners to form a Contractual Assessment District No. 2011. -1
