Owing to the late notice, I will not be able to attend the meeting, but I expect others will. I have several comments to the board, and trust you will forward this email. In addition, I will mail a paper copy for the records. On the minutes of the April 5th meeting, Item 7. Engineering: it states, Miyamoto -Mills has been working with homeowners in the El Toyonal -Alta Vista - Dos Osos area of many years to extend the public sewer service." The minutes should include the fact that the homeowners have categorically and repeatedly rejected any and all proposals to extend the sewer. Why was this omitted? Additionally it states "a number of participants have asked the district to ... fund the cost of non - participants' shares." The "number of participants" should be itemized, and identified as mostly non -home owning, non - resident lot owners who want to develop their lots. According to the minutes, the Liebers, Cohns, and Wanders are all proponents of the sewer, and made claims that septic systems in the area are failing. In addition, they proffered septic systems are polluting the reservoir. Did they cite a single failing septic system? Did they present any tangible evidence about the reservoir? The minutes don't mention any, so I'll assume these claims are both unsupported and exaggerated. More importantly, the Cohns submitted plans for a septic system for the home they want to build on their lot. Their request to install was denied, based on the 1970 Moratorium of new septic tank installations. So, if the Cohns think septic systems are so bad for the environment why did they pay good money to draw elaborate plans and hire an attorney to present their case to install one? According to the Minutes, Joe Lieber requested a speedy installation of the sewer, or else he would "repair his septic system." Again, if he thinks septic systems are so bad for the environment, why would he repair his? I trust the board will take all of this into consideration. More importantly, at least 3 homes in the Alta Vista area have recently replaced their wooden septic systems with very modern counterparts. Two homes have recently completed more minor repairs. None of the septic systems in use are failing. In addition, I recently discussed this matter with some colleagues; all very prominent scientists employed at the Lawrence Berkeley National Laboratory. Some are groundwater geologists (hydrologists) and others are soil microbiologists. Their unanimous opinions of septic systems are quite favorable. One PhD claimed septic systems are one of the best, man made designs ever devised to effectively deal with homeowner waste water. The reason is that they are very simple and they work with nature. An air tight tank provides an ideal environment for the anaerobic bacteria that consume solid waste. The liquid waste passes into the ground where literally billions of micro organisms in the soil break it down. One professor said, "If someone urinated on the ground, waited 3 days, and could possibly recover every drop of that liquid 10' away, it would be cleaner than what comes from the tap. The suggestion that liquid waste from Alta Vista, 11 00' above the reservoir could pollute it, is preposterous." In addition, he pointed out that East Bay MUD maintains a "protected watershed" throughout the hills that border the reservoirs, AND they allow dozens of cattle to graze on the property for months at a time. Cows urinate 13 gallons and drop 50 pounds of mostly solid excrement every day. None of this threatens the reservoir because nature breaks down all waste LONG before it reaches the water. Moreover, EBMUD would have shut down our entire septic using community decades ago if septic pollution was adversely affecting the drinking water for millions of people. On the other hand, East Bay MUD has expressed concerns about providing water for additional homes on Dos Osos and Alta Vista. They have no plans to replace the one water tank on the hill and will resort to refilling it more frequently. Additional pumping charges will be absorbed by all the residents of the hill. If the proponents of the sewer have environmental concerns, have they calculated the carbon footprint of installing a sewer? Driving trucks, trenchers, back hoes, and paving equipment up a steep hill every day for months will have a tremendous impact. The proponents also want to build homes. Have they calculated the environmental damage of their heavy equipment and delivery trucks up these hills? What about the damage caused by excavation, tree removal, and soil compression? How about the destruction of habitats and niches? The displacement or death of birds, rodents, amphibians, reptiles and mammals? All OK? Consider just the trucks that will drive up these steep hills, laden with lumber, glass, concrete, roofing material, asphalt, rocks, and all the other weighty items needed to build a home. It seems to me that someone concerned about water pollution would surely be horrified by these environmental travesties. Have the people who support the sewer "for environmental concerns" given any indication about this environmental damage? In the meeting minutes, President Nejedly is quoted as saying the board provides sewer service and its role is not to be pro or anti - developer. Make no mistake. The request for this exception is motivated almost entirely by non - residents who want to develop their lots on the hill. A few months ago, one opponent of the sewer was verbally threatened by a proponent. Several years ago, an opponent was vandalized after declining a sewer easement to a lot owner. While the culprits were never apprehended, the timing and location of the vandalism were extremely suspicious. If the board grants the exception, I understand this may invoke the ire of the residents of Del Valle and Vista del Orinda, who were forced to pay for their sewer. They were not granted an exception. Why should this case be any different? On behalf of all opponents who appear on the attached, I respectfully request the board to decline the request to make an exception to its CAD policy. We returned the district survey stating we oppose the sewer project. We were very surprised to learn the district'had no record' of our opposition. We are very concerned about the impact of the sewer construction on the stability of the land. We already have many unmitigated slides in the neighborhood. Just put in a $50k septic system. We at 42 Alta Vista will support no sewer. We just want to go on the record that we, Mike and Lee Callaham at 62 Alta Vista are against the sewer proposal.Let me add that when some of these developers were trying to get a sewer through by a different maneuver some years ago, they tried to get an easement from us and the plan was to tear up Alta Vista to do so. They offered to patch up the road afterwards, but not repave. Bear in mind also some portions of this road are unstable. This would involve a lot of construction and disruption. already attached to sewer on Las Piedras House vacant. Owner passed away. Executor of estate in favor of sewer as he anticipates a higher sale price. The Sgro's, at 49 Dos Osos are against the sewer project. The Holmes family is against the sewer coming up. Dan spoke with the CCCSD about two months ago and told them we were opposed and we would not use it. Eleven new houses would add considerable traffic and hazard forever, and would greatly compromise our ability to evacuate in an emergency. When I explained they would have to pay tens of thousands of dollars to install a line from the street to their house AND pay $20 -$30K to hook up, she opposed it outright.
