SUBJECT: OUTSTANDING DEVELOPMENT SERVICES FEES - UPDATE
At its March 15, 2012 regular meeting, the Board received a report on the recently
concluded Audit of Permit Counter and Connection Fee Connection Practices by Bartle
Wells Associates. The Board directed staff to report progress on implementing the
audit's recommendations at each subsequent Board meeting. This memo presents our
third report. Over the past two weeks, staff has done the following:
• Developed a protocol for outstanding fees that require field inspection. Staff will
send a letter to each property advising them that the District needs to access the
property to confirm whether a sewer connection or repair has been completed.
Observed in the initial stage of the evaluation effort that a number of the
outstanding fees are related to sewer mainline jobs. These are fees setup in
SunGard for the District's design review and inspection services for developers'
sewer main extensions. In poor economic conditions these applications are
frequently postponed or cancelled. Seldom do we get a cancellation notice
though. Thus the projects get "shelved" and the outstanding fees remain in the
system.
• Obtained matrix for possible collection scenarios from legal counsel. Staff is
integrating that into the collection effort.
Scheduled a meeting with City of Walnut Creek building permit and public works
staff to seek improved collaboration between our agencies including requiring
CCCSD inspector sign off for final building inspection. This is the third agency to
be contacted.
The application evaluation team's work will be completed by June 30, 2012. Where
applications with verified fees owed are identified, staff will immediately commence
pursuing collection. Collection efforts may extend into 2013 depending on the volume
and complexity of applications where we determine that fees are collectible.
