ISSUE: On April 10, 2012, six sealed bids were received and opened for the
construction of the Outfall Improvements, Phase 6 Project, District Project 7290. The
Board of Directors must award the contract or reject bids within 50 days of the bid
opening. Authorize the General Manager to execute the contract documents subject to
SUBMITTAL requirements. Approval by the Board of Directors is required for a
supplemental authorization to the Treatment Plant Program of the Capital Improvement
Budget.
RECOMMENDATION: Award a construction contract, and authorize the General
Manager to execute the Contract Documents subject to favorable review of insurance
certificates, bond submittals, appropriate Contractor license, and any other required
submittals (SUBMITTALS); and approve a supplemental authorization of $4,000,000
for the Treatment Plant Program of the Capital Improvement Budget (CIB).
FINANCIAL IMPACTS: Approximately $3,300,000, including design, bid price,
contingency, and construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended; and
an alternative to approving the supplemental authorization would be to not construct the
project.
BACKGROUND: The treatment plant outfall was built in 1958 in soils that shift and
settle significantly over time. In 1988, as part of the Outfall Rehabilitation, Phase 2
Project, and in 2003, as part of the Outfall Improvements, Phase 5 Project, the land
section of the outfall was bypassed to inspect its condition and make repairs. In 1988,
138 joint seals were installed, and 305 additional seals were installed in 2003, out of a

total of 1,550 joints. The submarine portion of the outfall has been inspected inside and
out in 2006, 2009, and most recently in 2011. The 2011 report identified damaged/
missing tie downs at the end of the submarine section. This project will allow for the
inspection of both the land and submarine portions of the outfall, and to make repairs
that are identified. Attachments 1 a and 1 b show the locations of the project work.
The project will retest the land portion of the outfall in a similar fashion to the work
performed in 2003, and install new joint seals as necessary. The submarine portion will
be inspected by divers and stabilized /protected from boat anchors in Suisan Bay with
additional ballast rock. This project will utilize the recently completed Wet /Dry Weather
Bypass Structure to bypass final effluent flow directly to Lower Walnut Creek. An
approval letter to use the Bypass Structure from the Regional Water Quality Control
Board (RWQCB) was received on February 16, 2012. Additionally, the project will
construct a new final effluent magnetic flow meter contained within a new meter vault.
In 2011, District staff executed a Professional Engineering Services Agreement with
Complete Project Solutions (CPS) to prepare design drawings and specifications to
construct the new flow meter vault. CPS and District staff prepared the plans and
specifications for the project. The Engineer's estimate for construction of Outfall
Improvements, Phase 6 Project, District Project 7290, is $2,100,000. This project was
advertised on March 16 and 22, 2012. Six (6) sealed bids, ranging from $2,234,500 to
$3,588,604 were received and publicly opened on April 10, 2012. The Engineer's
estimate was lower than the bidder's prices due to an under estimate of the total costs
for groundwater control, which included removal, on -site storage, analysis by a certified
analytical laboratory, and transport to a specified discharge point. The Engineering
Department conducted a technical and commercial review of the bids and determined
that Sierra Mountain Construction, Inc. is the lowest responsive bidder, with a bid
amount of $2,234,500. A summary of bids received is shown in Attachment 2.
The Outfall Improvements, Phase 6, Project is included in the Fiscal Year 2011 -12
Capital Improvement Budget (CIB) on pages TP -39 to TP -40. Staff has conducted a
cash -flow analysis of the Capital Improvement Program budget and concluded that
adequate funds are available for this project.
District staff will perform construction management, contract administration, inspection,
survey, and office engineering. Staff recommends retaining CPS to provide support

services during construction for this project because CPS prepared the plans and
specifications and, therefore, has a solid understanding of the project design.
The funds required to complete this project, as shown in Attachment 3, are $3,010,000.
The total cost of the Outfall Improvements, Phase 6 Project, District Project 7290, is
anticipated to be $3,310,000.
At its January 12, 2012 meeting, the Board of Directors independently found this project
to be exempt from the California Quality Act (CEQA) under District CEQA Guidelines
Section 15301. A Notice of Exemption has been filed with the Contra Costa County
Clerk.
RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Award a construction contract in the amount of $2,234,500 for the construction of
the Outfall Improvements, Phase 6 Project, District Project 7290, to
Sierra Mountain Construction, Inc., the lowest responsive bidder,
2. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements, and
3. Approve a supplemental authorization of $4,000,000 for the Treatment Plant
Program of the Capital Improvement Budget
