ISSUE: The District Code and state law require that the Board conduct a public hearing
prior to considering placement of Capacity Use Charges, assessments for Contractual
Assessment Districts (CADs), Alhambra Valley Assessment Districts (AVADs) and fee
deferral programs on the County tax roll.
RECOMMENDATION: Establish June 7, 2012 as the date for a public hearing to
consider placing the Fiscal Year 2012 -13 Capacity Use Charges and assessments for
CADs, AVADs and the assessments for other fee deferral programs on the County tax
roll for collection.
FINANCIAL IMPACTS: None by this action, however, the staff recommendation to
place assessments and charges on the County tax roll is the most efficient and cost
effective method of collection. The direct billing alternative would incur additional staff
time and could result in a lower rate of collection of these charges.
ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the
recommended public hearing date or may elect to choose a different date. However, a
public hearing must be held prior to August 10, 2012 if assessments and charges are to
be placed on the County tax roll for collection.
BACKGROUND: Commercial tenants and commercial property owners may elect to
participate in the District's Capacity Use program for payment of Capacity Fees over a
15 -year period.
Property owners who have formed CADs have agreed to pay for sewer improvements
over a ten -year period. Property owners who have formed AVADs have agreed to pay
for sewer improvements over a 15 -year period. Payments are to be collected by placing
assessments on each property owner's tax bill.

Property owners who are converting their properties from septic tank to public sanitary
sewer, and AVAD non- participants who are connecting their properties may elect to
participate in the District's fee deferral programs.
The Board must conduct a public hearing prior to considering placement of charges and
assessments on the County tax roll for collection.
RECOMMENDED BOARD ACTION: Establish June 7, 2012 as the date for a public
hearing to consider placing Fiscal Year 2012 -13 Capacity Use Charges, and
assessments for Contractual Assessment Districts, Alhambra Valley Assessment
Districts, and other fee deferral programs on the Contra Costa County tax roll for
collection.
