ISSUE: A new resolution is needed to revise the boundaries of St. Mary's Road
Contractual Assessment District (CAD) No. 2011 -1 initiated in March 2011 and a
request has been made for the District to cover non - participant costs.
RECOMMENDATION: Adopt a resolution approving revised boundaries for St. Mary's
Road CAD No. 2011 -1 and rescinding Resolution 2011 -009. Deny the request for the
District to cover the non - participant costs because it is inconsistent with the current
CAD policy.
FINANCIAL IMPACTS: None at this time. The Board has approved CAD costs of
$391,000 to serve 17 properties. If the project is shortened, the revised costs are
estimated to be $322,000 for a project to serve 13 properties or $231,000 to serve 9
properties.
ALTERNATIVES /CONSIDERATIONS: The Board can reject or defer revising the
boundaries of the CAD. These actions would halt or delay the CAD proceedings.
Separately, the Board could agree to cover some of the non - participant costs.
BACKGROUND: At its March 17, 2011 meeting, the Board of Directors adopted
Resolution No. 2011 -008 to initiate formation of St. Mary's Road CAD No. 2011 -1 and
Resolution No. 2011 -009 to approve CAD boundaries. At the January 26, 2012
meeting, the Board approved formation of this CAD for a 1,557 -foot long sewer serving
17 properties. The CAD contract, however, has not been signed by some property
owners due to the high cost of participation and connection, as residential pumping
systems will be needed for each connection. At the January 2012 meeting, the
coordinating owner requested the Board consider covering some of the non - participant
costs to reduce the costs of participants. The Board directed staff to work with the
neighborhood on reducing project costs and increasing participation.
To reduce project costs, staff developed two revised CAD boundary options. Figure 1
shows the approved 17- property project. Figure 2 shows the 13- property option that

would shorten the sewer project by 333 feet and remove the four southern -most, non-
participating properties. This revision would reduce the estimated project cost by
$69,000, but still accommodate the City ball fields' second connection point. Figure 3
shows the 9- property option that would shorten the sewer project by 650 feet. This
option would remove eight properties, two of which were interested in participating.
Additionally, the option would remove the second southern connection point for the City
of Lafayette ball fields. This revision would reduce the estimated project cost by
$160,000, but increase the City's cost for its on -site private sewer system and on -site
restoration.
Two property owners have each agreed to take on an extra, reimbursable 3/4 -share of
project costs in addition to the share for their own property (for a total of 1.75 shares
each) and three owners have agreed to pay for one share each. Also, the City of
Lafayette staff has indicated the City would consider taking on a second, non -
reimbursable cost share, in exchange for a second connection point at the southern
end of the ball fields' property. The approved CAD boundaries would accommodate
that second connection point, as would the 13- property option.
A new resolution is needed to change the previously approved CAD boundaries so that
CAD planning can proceed. If approved, the new resolution would rescind Resolution
2011 -009. Also, a revised Engineer's Report will be prepared, circulated to the
potential participants, and submitted to the Board for re- approval. Staff recommends
that the CAD boundaries be changed to reflect the 13- property option as this option
would provide service to all of the interested parties while removing a number of
properties that are not interested in participating.
Additionally, the property owners are still requesting the District's additional participation
due to the relatively high cost of constructing a sewer project at this location and the
extra costs of each connection needing a residential pumping system. Table 1
compares this project's estimated cost per residential property to recent CADs
approved by the Board.
Under the recommended 13- property option, there would be 14 cost shares (2 for the
City of Lafayette and one for each of the remaining 12 properties). Of the owners
willing to participate, 8.5 cost shares are covered; leaving 5.5 cost shares
(approximately $146,000) they would like the District to cover.
Under the 9- property option, there would be 9 cost shares (only one for the City of
Lafayette and one for each of the remaining 8 properties). Of the owners willing to
participate, 5.5 cost shares are covered; leaving 3.5 cost shares (approximately
$70,000) they would like the District to cover.

Participation by the District in covering the non - participant's cost is not consistent with
the District's current CAD policy, so staff is recommending the request be denied.
Given the costs and level of participation, there is some possibility that a denial could
result in the CAD failing to be organized.
RECOMMENDED BOARD ACTION: Adopt a resolution approving revised boundaries
inclusive of the northernmost 13 properties for St. Mary's Road CAD No. 2011 -1 and
rescinding Resolution 2011 -009. Deny the request for the District to cover the non-
participant costs, because it is inconsistent with the current CAD policy.

RESOLUTION NO. 2012 -025
RESOLUTION APPROVING REVISED BOUNDARY MAP
ST. MARY'S ROAD CONTRACTUAL ASSESSMENT DISTRICT NO. 2011 -1
AND RESCINDING RESOLUTION 2011 -009
WHEREAS, a map entitled "Proposed Boundaries of St. Mary's Road Contractual
Assessment District No. 2011 -1" was approved by the Board on March 17, 2011 under
Resolution No. 2011 -009; and
WHEREAS, lack of interest by the four southernmost properties warrant revision of the
boundaries so that project planning may proceed; and
WHEREAS, a revised map entitled "Proposed Boundaries of St. Mary's Road Contractual
Assessment District No. 2011 -1" has been filed with the Secretary of the Central Contra
Costa Sanitary District ( "CCCSD ").
NOW, THEREFORE, the Board of Directors of the Central Contra Costa Sanitary District
( "Board ") resolves:
THAT Resolution No. 2011 -009 is hereby rescinded; and
THAT the revised map entitled "Proposed Boundaries of St. Mary's Road Contractual
Assessment District No. 2011 -1" is hereby approved and the boundaries shown on the map
indicating the extent of the territory included in a proposed contractual assessment district
(CAD) to be known as St. Mary's Road CAD No. 2011 -1, Central Contra Costa Sanitary
District, County of Contra Costa, California are hereby approved; and
THAT the Board intends to levy a contractual assessment upon participating parcels within
the described CAD in accordance with the benefit to be received by each parcel of land,
respectively, from the improvement. There shall be omitted from assessment, all public
streets, alleys and places, and all land belonging to the United States, the State of California,
Contra Costa County, and CCCSD, except for the City of Lafayette ball fields property at 711
St. Mary's Road, because it has been determined that no special benefit will be conferred on
any such land within the CAD; and
THAT the Board finds that the map is in the form and contains the matters prescribed by
Section 3110 of the California Streets and Highways Code; and
THAT the Board directs the Secretary of CCCSD to certify the adoption of this resolution on
the face of the map and to file a copy of the map with the County Recorder for placement in
the Book of Maps of Assessment and Community Facilities Districts.
