ISSUE: A new resolution is needed to revise the boundaries of Harper Lane
Contractual Assessment District (CAD) No. 2011 -2 initiated in September 2011.
RECOMMENDATION: Adopt a resolution approving revised boundaries for Harper
Lane CAD No. 2011 -2 and rescinding Resolution 2011 -054.
FINANCIAL IMPACTS: None at this time. If the CAD receives final approval from the
Board in the future, the CAD costs are estimated to be $600,000.
ALTERNATIVES /CONSIDERATIONS: Reject or defer revising the boundaries of the
CAD. These actions would halt or delay the CAD proceedings.
BACKGROUND: At its September 1, 2011 meeting, the Board of Directors adopted
Resolution No. 2011 -053 to initiate formation of Harper Lane CAD No. 2011 -2 and
Resolution No. 2011 -054 to approve CAD boundaries. Since that time, owners of two
properties outside the CAD boundaries have indicated interest in being served by a
CAD sewer and one property previously included in the boundaries is in the process of
connecting to a separate sewer. A new resolution is needed to change the previously
approved CAD boundaries so that CAD planning can proceed. If approved, the new
resolution would rescind Resolution 2011 -054. With revised boundaries, the CAD
sewer can be designed to serve the additional properties, preparation and public review
of the Engineer's Report can proceed, and the CAD can be brought back to the Board
for final approval.
RECOMMENDED BOARD ACTION: Adopt a resolution approving revised boundaries
for Harper Lane CAD No. 2011 -2 and rescinding Resolution 2011 -054.

WHEREAS, a revised map entitled "Proposed Boundaries of Harper Lane Contractual

the described CAD in accordance with the benefit to be received by each parcel of land,
respectively, from the improvement. There shall be omitted from assessment, all public
streets, alleys and places, and all land belonging to the United States, the State of California,
Contra Costa County, and CCCSD because it has been determined that no special benefit
will be conferred on any such land within the CAD; and
THAT the Board finds that the map is in the form and contains the matters prescribed by

THAT the Board directs the Secretary of CCCSD to certify the adoption of this resolution on
