ORR, P.E., DIRECTOR OF PLANT OPERATIONS �A - f �^ SUBJECT: NPDES PERMIT RENEWAL Central Contra Costa Sanitary District ( CCCSD) is regulated by a National Pollutant Discharge Elimination System ( NPDES) permit. Every five years the District submits a Report of Waste Discharge (ROWD) to the San Francisco Regional Water Quality Control Board (RWQCB) which is an application for the reissuance of the NPDES permit. The ROWD was submitted on June 1, 2011. On September 29, 2011 the RWQCB released a copy of the Tentative Order (which is the draft NPDES permit), Tentative Self- Monitoring Program, Fact Sheet, and Notice of Public Hearing. The RWQCB also opened the Tentative Order for public comments which were due on November 1, 2011. On October 31, 2011, and November 1, 2011, the Regional Water Board received two comment letters on the Tentative Order. The parties submitting comment letters were (1) the San Luis and Delta- Mendota Water Authority and the State Water Contractors and (2) the San Francisco BayKeeper. The subject comment letters contained assertions in support of requests for significant changes to the Tentative Order as released for comment. On December 8, 2011, Bay Area Clean Water Agencies ( BACWA) submitted a comment letter in response to the comment letters and in support of the Tentative Order as issued. The District submitted an extensive comment letter on December 28, 2011 to provide additional detail on some of the major assertions made by the Water Contractors and Baykeeper. Although the formal comment period ended on November 1, 2011, BACWA and CCCSD have requested that the comment letters be entered into the record under Title 23 of the California Code of Regulations. In order to allow time to consider the extensive comment letters received, the RWQCB has delayed consideration of approval of the Tentative Order until their February 8, 2011 meeting. Staff will provide an oral update and answer any Board questions at the January 12, 2012 Board meeting.
