ISSUE: Board of Directors' authorization is required for the General Manager to
execute a professional services agreement in an amount greater than $25,000.
RECOMMENDATION: Authorize the General Manager to execute a Professional
Consulting Services Agreement with Larry Walker and Associates with a cost ceiling of
$90,000 for assistance with the National Pollutant Discharge Elimination System
(NPDES) Permit Tentative Order.
FINANCIAL IMPACTS: Outcomes from the NPDES permit process will set Central
Contra Costa Sanitary District's new permit limits. When the limits are known, the
financial impact can be determined; there is a potential for substantial financial impact.
ALTERNATIVES /CONSIDERATIONS: The District could elect to permit without the
assistance of outside technical support. This is not recommended because of the
expertise needed to respond to comments received on the Tentative Order.
BACKGROUND: The District's NPDES Permit is currently scheduled to be renewed by
the. San Francisco Bay Regional Water Quality Control Board (RWQCB) on January 18,
2012. A Tentative Order was released in late October for public comment. The
RWQCB received two comment letters dated October 31, 2011 and November 1, 2011.
The first is from San Luis and Delta- Mendota Water Authority and the State Water
Contractors and the second is from San Francisco BayKeeper.
Larry Walker and Associates will provide support to the District in the preparation of
responses to those comments in the context of currently accepted scientific
understanding and ongoing regulatory initiatives for the San Francisco Bay -Delta
related to ammonia and nutrients.

Larry Walker and Associates will assist in responding to questions or comments raised
by the RWQCB in response to the Districts comments on the subject letters. Larry
Walker and Associates will assist the District in preparation for the Regional Board
hearing on the District's NPDES permit for those issues pertaining to the subject
comment letters. This assistance will include preparation of draft testimony and
attendance at the hearing, as requested. Staff recommends Larry Walker and
Associates since they have the expertise and familiarity with the issues in the
San Francisco Bay - Delta.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute a
professional consulting services agreement with Larry Walker and Associates with a
cost ceiling of $90,000 for assistance with NPDES Tentative Order.
