General Update
a) Review of Policies, Procedures and Practices for
Application of District Fees, Rates and Charges
At the Board Meeting on November 21, 2011, a District staff member, speaking as
a ratepayer, addressed the Board during public comments regarding concerns
that the District's fees, rates and charges be equitably applied to all customers.
As part of her comments, she suggested that an audit of the Environmental
Services Division's application of policies, procedures and practices regarding
fees, rates and charges be conducted.
The District's management team is committed to fairly and equitably administering
the District's fees, rates and charges. We take the concerns of employees and
customers very seriously. While the concerns presented at the Board Meeting did
not have the benefit of policy context or work underway to address the concerns
expressed, it is important to fully and transparently evaluate them. With this in
mind, we plan to engage the independent public finance advisory firm Bartle Wells
Associates to review the points raised in the public comments, as well as the
application of fees, rates and charges for transactions at the permit counter. We
believe that an independent review is appropriate at this time and is likely to
produce valuable recommendations for our programs going forward.
Before the comprehensive review begins, however, we thought it appropriate to
address one of the specific issue regarding sewer service charges for swim clubs.
During deliberations to establish the District's first sewer service charges (then
called the Environmental Quality Charge) in 1976, the Board decided that swim
clubs should be exempt from these charges (see attached Resolution 77 -1). This
Board policy has been followed since that time. If the Board wishes to revisit this
policy, staff suggests it be brought back to the Board along with any other findings
of the Bartle Wells Associates review.
Staff will keep the Board apprised of the progress of the Bartle Wells Associates
work and will bring their findings and recommendations back to the Board at a
future meeting.
RESOLUTION NO. 77 -1
A RESOLUTION EXEMPTING SWIMMING POOLS FROM THE
ENVIRONMENTAL QUALITY CHARGE
BE IT RESOLVED by the Board of Directors of the Central Contra Costa
Sanitary District as follows:
THAT, pursuant to Section 11 -703 of the District Code, the rates
for all swimming pool users shall be considered as included in the
residential environmental quality charge rates and no separate charge
will be made therefore.
PASSED AND ADOPTED this 6th day of January, 1977 by the District
Board of the Central Contra Costa Sanitary District by the following vote:
AYES: Members: Gibbs, Mitchell, Rustigian, Allan and Boneysteele
