Legislative Updates
a) Governor Signs Several Bills of Interest to the District
Governor Brown had until Sunday at midnight to sign or veto approximately 600
bills that were sent to him during the final weeks of the 2011 legislative session.
Several Bills that CCCSD has been following were acted on by Governor Brown
over the weekend:
i) SB 293 (Padilla) was signed by the Governor. This Bill limits the amount of
allowable retention proceeds on public works contracts to 5% (current law
allows up to 10 %) and goes into effect for all contracts initiated after January
1, 2012. You will recall that the 5% retention requirement in SB 293 has been
ongoing for at least a decade with three previous governors vetoing similar
Bills.
Several local government and education organizations, as well as hundreds of
individual public agencies, including CASA and CCCSD submitted letters of
opposition throughout the legislative process expressing serious concerns
over limiting retention proceeds on public works contracts. Ultimately, major
contractor and subcontractor groups supporting the Bill won the battle, arguing
that in this down economy, a 10% requirement prohibited many of them from
bidding on public works projects. The Bill does however sunset on December
31, 2015, when it is hoped that the economy will sufficiently recover and the
historical 10% retention requirement can be accommodated by contractors.
ii) AB 187 (Lara) was signed by the Governor. According to the latest
analysis of the Bill, AB 187 "authorizes the State Auditor to establish a high -
risk local government agency audit program to identify, audit, and issue
reports on any local government agency that the State Auditor identifies as
being at high risk for the potential of waste, fraud, abuse, or mismanagement
or that has major challenges associated with its economy, efficiency, or
effectiveness." CASA had a "watch" position on the bill.
Prior to this legislation, the State Auditor could only perform high -risk audits of
any state agency.

iii) AB 646 (Atkins) was signed by the Governor. The Bill establishes
mandatory fact - finding for public employers subject to the Meyers- Milias-
Brown Act (MMBA), and allows local public employee organizations to, among
other things, request fact - finding if a mediator is unable to reach a settlement
within 30 days of appointment. This Bill institutes a new mandatory impasse
procedure for negotiations. This new impasse procedure may significantly
impact the timing of negotiations because it will add, post- impasse up to 50
days or more to the process of either agreement or the point at which the
employer could unilaterally implement its last best offer if no agreement is
reached. Ultimately, the panel is required to "make findings of fact and
recommend terms of settlement." Only following completion of the fact - finding
process may the employer then implement its last, best, and final offer.
CASA, CSDA, ACWA, CaIPELRA, and other local government organizations
were opposed to the measure which was sponsored AFSCME and AFL -CIO,
and supported by other unions. The bill goes into effect on January 1, 2012.
iv) Bill Restricting Ballot Initiatives to November Elections Governor Brown
signed legislation on Friday, October 7 restricting California ballot initiatives to
November elections. This precludes any possibility of an initiatives being
included in the June 2012 election when voter turnout is usually low. The Bill
was passed by Democrats in the Legislature in the final hours of the legislative
session that ended on September 9.
There are several rather severe pension reform initiatives that might appear on
the November 2012 ballot. However, sponsors of these initiatives are having
difficulty in raising sufficient funds to gather the required number of signatures
for the initiatives to be placed on the November ballot.

b) 4th Quadrennial Contra Costa County Creek and Watershed
Symposium
The 4th Quadrennial Contra Costa County Creek and Watershed Symposium:
Changing Landscapes, Evolving Perspectives, will showcase the broad array of
work on local creeks and watersheds and draw on experts and success stories
from outside the County. The event will provide a venue where interested
individuals representing a wide variety of organizations and perspectives can
assemble and learn about timely and significant issues regarding the health of
creeks and watersheds. The District has been invited as one of the many
sponsors of the event. The event will take place at Antioch Community Center
located at 4703 Lone Tree Way in Antioch. Attachment "A" is the program for
your information.

d) Review of Board /District Policies and Procedures
At the September 15, 2011 Board meeting Member Williams requested that staff
identify and list all Board - approved policies, and that they be separated from
procedures, which should be managed by staff. Staff has begun this process
and will keep the Board apprised of its progress.

SUBJECT: Status of Contra Costa County Grand Jury Requests /Responses
Staff has recently reviewed all previous responses to Grand Jury requests since 2003 to
determine if there are any outstanding issues which require attention or further action.
Attached is a chart summarizing the District's responses to various Grand Jury
recommendations covering retiree health benefits, pension spiking and Board
compensation. While staff is not required to report further to the Grand Jury on any of
these matters, we recently received a letter from the Grand Jury asking the District to
report its action on one of those items and we did so.
In reviewing the responses, there are several areas where further analysis and /or action
was required to comply with the Grand Jury's requests. These recommended further
actions and their disposition are indicated on the chart.
This information is being brought to you to keep you apprised of the status of any
necessary follow -up to our Grand Jury responses. No action is required at this time.
