Farrell James M. elly, General M nager ISSUE: On September 27, 2011, 6 sealed bids were received and opened for the construction of the Primary Structures Demolition Project, District Project 7255. The Board of Directors must award the contract or reject bids within 50 days of the bid opening. Authorize the General Manager to execute the contract documents subject to SUBMITTAL requirements. Authorize the General Manager to execute an amendment to the Professional Engineering Services Agreement over $50,000. RECOMMENDATION: Find that the project is exempt from the California Environmental Quality Act (CEQA); award a construction contract, and authorize the General Manager to execute the Contract Documents subject to favorable review of insurance certificates, bond submittals, appropriate Contractor license, and any other required submittals (SUBMITTALS); and authorize the General Manager to execute an amendment to the Professional Engineering Services Agreement with Complete Project Solutions, Inc. (CPS). FINANCIAL IMPACTS: Approximately $1,480,000, including design, bid price, contingency, and construction management. ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended. BACKGROUND: The original primary sedimentation tanks, constructed in 1948 and 1957, have been out of service and abandoned for decades. This project will safely remove these tanks and backfill those areas. The lime storage building and silos, located to the east of the Headquarters Office Building, were constructed in 1974 to store lime used in the primary sedimentation process. This lime facility has not been used in over 20 years and will also be demolished under this project. Additionally, the project will remove various abandoned piping and equipment throughout the treatment plant and slurry seal paved areas needing rehabilitation. FOR THE CONSTRUCTION OF THE PRIMARY STRUCTURES DEMOLITION PROJECT, DISTRICT PROJECT 7255 mitigation of asbestos containing material (siding on the lime silos enclosure) and lead - based paint (painted handrails in the old primaries). Attachment 1 shows the locations of the project work. In 2008, District staff executed a Professional Engineering Services Agreement with CPS to prepare design drawings and specifications to demolish the abandoned primary tanks. CPS and District staff prepared the plans and specifications for the project. The Engineer's estimate for construction of the Primary Structures Demolition Project, District Project 7255, is $1,400,000. This project was advertised on September 2 and 9, 2011. Six sealed bids, ranging from $929,000 to $1,443,600, were received and publicly opened on September 27, 2011. Engineering Department staff conducted a technical and commercial review of the bids and determined that Pantano Excavating, Inc. is the lowest responsive bidder, with a bid amount of $929,000. A summary of bids received is shown in Attachment 2. District staff will perform construction management, contract administration, inspection, survey, office engineering, and submittal review. CPS has performed satisfactorily during the design phase of this project and staff recommends retaining CPS to provide construction support services during construction of this project. The construction supports services include reviewing shop drawings and submittals, responding to design questions, evaluating change order requests, and performing site visits to verify compliance with the design intent. Staff has negotiated an amendment to the Professional Engineering Service Agreement with CPS in the amount of $30,000. This will bring the total contract cost for design and construction support services to $75,000. In addition to CPS, staff will retain a consultant specializing in asbestos and lead paint removal to assist in technical support/inspection. The funds required to complete this project, as shown in Attachment 3, are $1,325,000. The total cost of the Primary Structures Demolition Project, District Project 7255, is anticipated to be $1,480,000. This project is included in the fiscal year (FY) 2011 -2012 Capital Improvement Budget (CIB) on pages TP -43 and TP -44. Staff has conducted a cash -flow analysis of the Treatment Plant Program budget and concluded that adequate funds are available for this project. Staff has concluded that this project is exempt from the California Environmental Quality Act (CEQA) under District CEQA Guidelines, Section 15301, since it involves minor alterations to an existing public facility involving negligible or no expansion of use.
