Mi amoto -Mills C. Swanson A. Farrell James M. K ly, General M ager ISSUE: The City of San Ramon has requested that our HHW services agreement be restructured. The current agreement will automatically renew with its existing terms on September 26, 2011. The terms of the agreement allow either party to cancel the agreement by giving sixty days notice prior to the renewal date. Staff has been working with the City to create options for the Board's consideration, however, the agreement will renew before it can be completed. RECOMMENDATION: Authorize the General Manager to extend the HHW Services agreement with the City of San Ramon through December 2, 2011. Staff will come back to the Board with options for a new agreement once negotiation of the restructured agreement is completed. FINANCIAL IMPACTS: No financial impacts are expected by extending the agreement. ALTERNATIVES /CONSIDERATIONS: Let the agreement automatically renew on September 26, 2011 for another year. Do not accept San Ramon's request to restructure the agreement and continue with the existing agreement language and conditions. BACKGROUND: In June, the City of San Ramon sent a written request asking that the District restructure the current HHW services agreement that allows the roughly 5,000 San Ramon homes that are in the Dublin San Ramon Services District (DSRSD) to use the HHW Program for a fee equivalent to what the District ratepayers pay for the HHW Program. San Ramon wishes to reduce its costs by revising the method for which the District charges them for HHW services. This will in turn help San Ramon pay for its new door -to -door HHW collection program that began this past May. The City of San Ramon has had the existing HHW Services agreement with the District since 1997. During 2009 -10, the San Ramon household participation was 5% compared to an overall average of 15 %. The San Ramon participation rate includes participants at an annual temporary collection event that the District has conducted as a way to increase participation by San Ramon households. Staff is working with the City to create options for the Board's consideration. Staff proposes to negotiate a new agreement with San Ramon that will base the City's cost share for the HHWCF more on actual use rather than the percentage of households. As San Ramon and the other HHWCF partners are billed in arrears, the payment provisions of the proposed new agreement would be retroactive to the beginning of the fiscal year, July 1, 2011. Staff has met with representatives of our other HHWCF partners, the cities of Clayton and Concord, and the Mt. View Sanitary District to discuss San Ramon's request. All of the partners support the proposal. At its September 13 meeting, the Board Household Hazardous Waste Committee will consider extension of the agreement through December 2, 2011. RECOMMENDED BOARD ACTION: Authorize the General Manager to extend the HHW Services agreement with the City of San Ramon through December 2, 2011.
