IMPROVEMENTS PROJECT, DISTRICT PROJECT 7241, AND AUTHORIZE
FILING OF THE NOTICE OF COMPLETION

ISSUE: Construction has been completed on the Wet Weather Bypass Improvements,
District Project 7241, and the work is now ready for acceptance.
RECOMMENDATION: Accept the contract work for the Wet Weather Bypass
Improvements, District Project, District Project 7241, and authorize filing of the Notice of
Completion.
FINANCIAL IMPACTS: None related to this action.
ALTERNATIVES /CONSIDERATIONS: Not applicable. Filing the Notice of Completion
is advisable under the California Civil Code, Section 3093.
BACKGROUND: The wet/dry weather bypass project improved the storage and
discharge of flows during peak wet weather events and inspection /maintenance of the
outfall during the summer months. The previous bypass point located in Basin C had
insufficient capacity during dry- weather flows, which resulted in flooding of adjacent
properties owned by others. This situation is further exacerbated during wet - weather
events.
The Wet Weather Bypass Improvements Project was constructed in two phases. The
first phase of this project involved placing a preload fill to consolidate the soft, organic
clay soils that underlie the site of the new bypass structure. The preload construction
work was completed and accepted by the Board of Directors on November 6, 2008.
The second phase of the project constructed improvements to the dry/wet weather
discharge system, such as widening of existing bypass channels, constructing the
gravity overflow structure, and constructing the box culvert to discharge directly to
Walnut Creek.
On June 17, 2010, the Board of Directors authorized the award of a contract for the
construction of the project to Siteworks Construction, Inc. The Notice to Proceed was
issued on July 14, 2010. The work was substantially completed on July 29, 2011. The

remaining items of work consist of minor punch -list items, which do not affect the
project acceptance.
Immediately upon acceptance, the Contractor is relieved of the duty of maintaining and
protecting the Contract work. Guaranty and warranty periods required by the Contract
and the statutory period for filing of liens and Stop Notices start on the date of
acceptance by the Board of Directors. Final payment to the Contractor is made after
expiration of the statutory period for filing of liens and Stop Notices, provided no liens or
Stop Notices have been filed, and provided the punch -list items have been completed.
The total authorized budget for the project is $3,784,000. The budget includes the cost
of engineering design, construction management and inspection, testing services,
change orders, and contractor services. It is appropriate to accept the contract work at
this time.
RECOMMENDED BOARD ACTION: Accept the contract work for the Wet Weather
Bypass Improvements, District Project 7241, and authorize filing of the Notice of
Completion.
