Alm James M elly Counsel for the District General Manager ISSUE: Grant applications to the U.S. Bureau of Reclamation (USBR) require the District to adopt and submit a resolution by the Board of Directors in support of the application. RECOMMENDATION: Adopt resolution supporting grant application to the USBR for the development of a feasibility study and associated environmental compliance documentation for the Contra Costa County Refinery Recycled Water Project. FINANCIAL IMPACTS: The estimated cost to complete a feasibility study and associated environmental documentation for the Contra Costa County Refinery Recycled Water Project is approximately $360,000. If awarded and accepted, the grant would be for approximately half of that amount up to $179,991.93, and the District would be committed to fund the remainder of the cost. ALTERNATIVES /CONSIDERATIONS: An alternative would be to not support the grant funding application. However, the District would lose this opportunity to get up to 50% of the work grant funded. BACKGROUND: As part of the Bay Area Recycled Water Coalition ( BARWC), the District is seeking federal funding assistance for the Refinery Recycled Water Project through the Title XVI Program. District staff recently learned that approximately $2 million in appropriated but unallocated money may be available from USBR and must be allocated by September 30, 2011, the end of the Federal fiscal year. These funds are limited to use for Title XVI feasibility studies and associated environmental compliance documentation. The funds can either be spent for retroactive reimbursement of feasibility studies and environmental compliance activities already completed or for new studies. These monies will be distributed based on BARWC recommendations for members of the Coalition that have projects ready to go and who have the ability to match the grant funds with a contribution of their own. For the nomination to move forward, the District must adopt and submit a copy of a resolution by the Board of Directors in support of the application by August 26, 2011. If the District is awarded the grant, the District must complete the feasibility study and environmental compliance documentation by September 30, 2013. Staff has estimated that the cost of completing a feasibility study and associated environmental compliance documentation is approximately $360,000. If received, the grant would provide funding for approximately 50% of the costs or up to $179,991.93. While the District has not yet been successful at identifying financial partners for the implementation phase of this project, forming a partnership with USBR to conduct a feasibility study and environmental review would be a very positive first step in building legitimacy for this project as a project of regional and state wide significance. By adopting this resolution, and if the USBR grant is awarded and received by the District, the Board is committing the District to fund the portion of the costs of the feasibility study and associated environmental compliance documentation that are not covered by the grant from the USBR. The Refinery Recycled Water Project is included in the District's 2011 -12 Capital Improvement Budget (CIB) beginning on page RW -6. At this time, budget is only included for planning activities and to pursue outside funding assistance. In parallel to pursuing Title XVI funding, the District is also pursuing funding for this project through the Federal Water Resources Development Act (WRDA). RECOMMENDED BOARD ACTION: Adopt resolution supporting grant application to the USBR for the development of a feasibility study and associated environmental compliance documentation for the Contra Costa County Refinery Recycled Water Project. NAENVRSEC \Position Papers \Berger \2011 \Pos Paper CCC Refinery Project 8- 4- 11.doc RESOLUTION NO. 2011 -033 A RESOLUTION OF THE CENTRAL CONTRA COSTA SANITARY DISTRICT AUTHORIZING APPLICATION TO THE U.S. BUREAU OF RECLAMATION The Board of Directors of the Central Contra Costa Sanitary District ( "District "), a public agency located in Contra Costa County, California, formed under the Sanitary District Act of 1923, hereby states and resolves as follows: WHEREAS, the General Manager, James M. Kelly, and his designees have reviewed and support the application submitted to the U.S. Bureau of Reclamation for funding of a feasibility study and associated environmental compliance activities for the Contra Costa County Refinery Recycled Water Project; and WHEREAS, based on the review of the application submitted to the U.S. Bureau of Reclamation for funding of the feasibility study, the District seeks to move forward with the application process and procure partial funding from the U.S. Bureau of Reclamation for this feasibility study; and WHEREAS, the District is capable of and is committed to providing the non - federal share of the cost of conducting the feasibility study and associated environmental compliance activities for the Contra Costa County Refinery Recycled Water Project, estimated not to exceed $179,991.93 for the District portion, with the U.S. Bureau of Reclamation's portion not to exceed $179,991.93. NOW, THEREFORE, BE IT RESOLVED BY THE Board of Directors of the Central Contra Costa Sanitary District as follows: a. Upon award of federal financial assistance, the General Manager, James M. Kelly, is hereby authorized and directed to enter into an agreement with the U.S. Bureau of Reclamation for the funding of a feasibility study and associated environmental compliance activities for the Contra Costa County Refinery Recycled Water Project; and b. The General Manager, James M. Kelly, is hereby authorized and directed to work with the U.S. Bureau of Reclamation to meet the established deadlines for entering into a cooperative agreement to perform a feasibility study and associated environmental compliance activities for this project; and C. In order to fulfill the requirements of the Funding Opportunity Announcement (Number R11AF20020), the General Manager, James M. Kelly, is hereby authorized and directed to exercise the full authority of the District to submit a copy of this resolution to the U.S. Bureau of Reclamation and to take such other actions on behalf of Resolution 2011 -033 Page 2 the District as may be required by the U.S. Bureau of Reclamation to complete the application process and obtain the federal financial assistance.
