Re lly General Manager ISSUE: A resolution of the Board of Directors passed by four affirmative votes is needed to place charges on the Contra Costa County tax roll. RECOMMENDATION: Adopt a resolution directing that additional 2011 -12 assessments for the Alhambra Valley Assessment Districts, and assessments for other fee installment payment programs be collected on the Contra Costa County tax roll. FINANCIAL IMPACTS: This action will provide for collection of approximately $4,949.89 in 2011 -12 assessments from properties that formed Alhambra Valley Assessment Districts and other fee installment payment programs. ALTERNATIVES /CONSIDERATIONS: Not applicable. BACKGROUND: In 2010, the Board approved two new user categories that could participate in the capacity fee installment payment program: 1) new participants in an existing Alhambra Valley Assessment District (AVAD), and 2) existing homeowners converting from septic tanks. Property owners who are connecting their properties in an AVAD may elect to participate in the district's installment payment program for AVADs. Under this program, which was approved by the Board on July 15, 2010, the time period for direct and indirect connectors to become participants in existing AVADs was extended to June 30, 2015. This program allows payment of capacity fees, annexation charges, AVAD charges, and indirect trunk line charges over a 15 -year period rather than at the time of connection. Property owners who are converting their properties from septic tank to sanitary sewer may elect to participate in the District's capacity fee installment payment program. CONDUCT A PUBLIC HEARING TO RECEIVE COMMENTS ON AND CONSIDER ADOPTION OF A RESOLUTION DIRECTING THAT ADDITIONAL 2011 -12 ASSESSMENTS FOR ALHAMBRA VALLEY ASSESSMENT DISTRICTS AND OTHER FEE INSTALLMENT PAYMENT PROGRAMS BE COLLECTED ON THE CONTRA COSTA COUNTY TAX ROLL this program, which was approved by the Board on September 2, 2010, a homeowner who is abandoning a septic tank and connecting to the sanitary sewer is allowed to finance the capacity fees over a ten -year period rather than pay the capacity fees at the time of connection. These properties are listed in the attached Exhibit A. Payments are to be collected by placing assessments on each property owner's tax bill. The Board approved a resolution on May 5, 2011 to place assessments for installment payment programs on the Contra Costa County tax roll. Since that time, several additional property owners have signed installment payment agreements under these programs, and FY 2011 -12 assessments for these programs should be added to the Contra Costa County tax roll in August 2011. To avoid multiple Board actions, beginning next year, staff will schedule Board consideration of adding installment payments to the Contra Costa County tax roll during July or early August instead of in May. A resolution of the Board is needed to place assessments for Alhambra Valley Assessment Districts and other fee installment payment programs on the Contra Costa County tax roll. RECOMMENDED BOARD ACTION: Adopt a resolution directing that assessments for Alhambra Valley Assessment Districts and other fee installment payment programs be collected on the Contra Costa County tax roll.
