ISSUE: Board authorization is required for the General Manager to execute a
professional services agreement in an amount greater than $50,000.
RECOMMENDATION: Authorize the General Manager to execute an amendment to
the existing professional services agreement with RMC Water and Environment in the
amount of $135,000 for a new contract ceiling of $185,000 for assistance with National
Pollutant Discharge Elimination System (NPDES) Permit renewal process.
FINANCIAL IMPACTS: Up to $135,000 may be expended from the technical services
budget. Outcomes from the NPDES permit process will set Central Contra Costa
Sanitary District's new permit limits. When the limits are known, the financial impact
can be determined; there is a potential for substantial financial impact.
ALTERNATIVES /CONSIDERATIONS: The District could elect to negotiate the permit
without the assistance of outside technical support. This is not recommended because
the person engaged from RMC negotiates permits regionally and is current with
potential issues and resolutions that have worked with other dischargers to the
San Francisco Bay.
BACKGROUND: The District's NPDES Permit is currently scheduled to be renewed by
the San Francisco Bay Regional Water Quality Control Board in March of 2012.
Because of their specialized experience, the District hired RMC Water for assistance in
development of the Report of Waste Discharge (ROWD) that was submitted on June 1,
2011. As reported to the Board on January 6, 2011, the initial phase of the work cost
approximately $50,000. The next phase of the work will require a quick turnaround
review of draft language for the new permit, analysis of potential permit changes, and
formulation of comments. The level of effort in any phase of the renewal process is
subject to the content of the new permit and could cost $135,000. Attorney fees are

also anticipated for this effort. Important milestones in the permit reissuance cycle will
be communicated to the Board.
RECOMMENDED BOARD ACTION: Authorize the General Manager to execute an
amendment to an existing professional services agreement with RMC Water and
Environment in the amount of $135,000 for a new contract ceiling of $185,000 for
assistance with National Pollutant Discharge Elimination System (NPDES) Permit
renewal process.
