ISSUE: Section 6490 of the Health and Safety Code of the State of California provides
that District ordinances shall be published once in a newspaper of general circulation
within the District, and provides that an Order of the Board of Directors of the District to
the effect that the, ordinance has been published shall constitute conclusive evidence
that publication has been properly made.
RECOMMENDATION: Confirm the publication of a summary of District Ordinance
No. 265.
FINANCIAL IMPACTS: None.
ALTERNATIVES /CONSIDERATIONS: Establishes presumption that the ordinance
was correctly published and therefore would be deemed procedurally valid by a court.
BACKGROUND: A summary of District Ordinance No. 265, which was adopted by the
Board at its meeting on May 5, 2011, and which updates the uncodified Schedule of
Capacity Fees, Rates and Charges, was published in the Contra Costa Times and the
San Ramon Valley Times on May 23, 2011. Proof of publication is attached.
RECOMMENDED BOARD ACTION: Confirm the publication of a summary of District
Ordinance No. 265.

ADOPTNO AN UNCODIFIED SCHEDULE OF CAPACITY
FEES, RATES ANTRICT CODE ICHAPTACCORDANCE ER 122 WITH
Ordinance No. 265 adopts an uncodified "Schedule
Of Capacittyy Fees, Rates and Charges" including an
increase of the Gravity Capacity Fees from 5451
cr $5,465 per Residential Unit Equivalent, and a de-
crease of the Pumping C ity Fee from $1,641 to
$1,606 per Residential nit Equivalent These
Changes result in a Gravity Zone Fee (zone 1) of
S5 465 per Residential Unit Equivalent, and a Pump-
Zone Fee (Zone 2) of $7,071 per Residential Unit
Equivalent The new fees will be effective on July 5,
2011.
NOTE: The above is asummauy of major highlights
of the proposed ordinance. A readin.9 of the entire
ordinance may be necessary to obtain a full under-
standing of all of the charges proposed. A certi-
fied copy of the full text of the proposed ordinance
Is posted and may be read in the Secretary of the
