HomeMy WebLinkAbout05.a.1) & 05.a.2) (Handout)(Aa.d.-+) Public Hearing: Delinquent Charges Curt Swanson June 16, 2011 bawl L Central Contra Costa Sanitary District Delin uent Char es (161 Twin Peaks Drive, Walnut Creek) • Gregory Reginato, a contractor, connected a new home at 161 Twin Peaks Drive, Walnut Creek, to the public sewer without securing a CCCSD permit or payment of Connection Fees. « In 2005, Mr. Reginato agreed to pay one -half of the fees due, with the homeowners paying the other half. • The homeowners paid their share in full. • Mr. Reginato paid $1,000 of the $2,195 he owed. f S.A.2) 1 Delinquent Charges (161 Twin Peaks Drive, Walnut Creek) • Staff has been unsuccessful in collecting the remaining amount. • The total amount owed is $2,190.56, including a 10% delinquent charge and penalty at 11/2% per month. • Recommendation: Adopt a resolution directing staff to record a "Certificate of Unpaid Charges" to establish a lien on Mr. Reginato's home in El Sobrante as allowed by Health & Safety Code Section 6520.12. N Delin uent Char es (2375 Contra Costa Boulevard, Pleasant Hill) • In 2007, Monsoon Masala Restaurant opened in a converted retail space at 2375 Contra Costa Boulevard without securing a CCCSD permit or paying approximately $42,000 in Connection Fees. • In 2008, the business owner agreed to an aggressive special installment payment plan, and paid more than half of the amount owed by November 2008. Erz�CD Delinquent Charges (2375 Contra Costa Boulevard, Pleasant Hill) At that time, the business owner asked to suspend the payment plan for one year citing impacts of the recession. Payments were to resume in February 2010. • No further payments have been received, and the amount owed became delinquent in August 2010. The total amount owed is $28,260.96, including a 10% delinquent charge and penalty at 11 /z% per month. 3 Delinquent Char es (2375 Contra Costa Boulevard, Pleasant Hill) • Property sold in November 2010. • The business owner has recently proposed a new plan where monthly payments of $1,000 would be made until the debt is fully discharged. • The Board could consider this proposal or direct staff to work with the business owner on an alternative payment plan. • Board could lien owner's and /or tenant's homes. Delinquent Charges (2375 Contra Costa Boulevard, Pleasant Hill) • Public Hearing Issues: Consider directing staff to: 1) Place delinquent charges on the 2011 -12 County tax roll; 2) Record a Certificate of Unpaid Charges to establish a lien on the property as allowed by Health & Safety Code Section 6520.12; 3) Terminate sewer service by disconnection of the property from the public sewer on August 1, 2011. • Recommendation: Direct staff to negotiate a new payment plan with the business owner. Adopt resolution to implement item 2), but withhold recording of the lien provided the business owner does not default on the new payment plan. 4 Questions? S
