ISSUE: The District has received a claim from Susan McCollom for the cost to repair a
lateral connection.
RECOMMENDATION: Deny the claim.
FINANCIAL IMPACTS: Denying the claim has no fiscal impact.
ALTERNATIVES /CONSIDERATIONS: The alternative is to accept the claim and pay
the claimant $6,447.00.
BACKGROUND: The claimant became aware of a problem with the lateral at 3564
Brook Street in Lafayette in January 2011 after calling a plumbing company to address
a plugged toilet. When the plumbing company was unable to snake the lateral as far as
the main, the District was called to investigate the problem. They discovered that the
lateral had separated from the main.
A review of District records showed that no repairs or replacements have been made to
this line since before 1990. After further investigation, it appeared that the lateral was
damaged and subsequently repaired without a District permit during the City's
installation of a storm drain pipeline.
The Budget & Finance Committee reviewed this matter at the June 13, 2011 meeting.
RECOMMENDED BOARD ACTION: Deny the claim.
