ISSUE: On May 17, 2011, eight sealed bids were received and opened for the
construction of the Perimeter Fencing, District Project No. 7282. The Board of
Directors must award the contract or reject bids within 50 days of the bid opening.
Authorize the General Manager to execute the contract documents subject to
SUBMITTAL requirements.
RECOMMENDATION: Find that the project is exempt from the California
Environmental Quality Act (CEQA), award a construction contract, and authorize the
General Manager to execute the Contract Documents subject to favorable review of
insurance certificates, bond submittals, appropriate Contractor license, and any other
required submittals (SUBMITTALS).
FINANCIAL IMPACTS: Approximately $165,000, including design, bid price,
contingency, and construction management.
ALTERNATIVES /CONSIDERATIONS: Reject all bids, which is not recommended.
BACKGROUND: This project will replace 5,200 feet of 6 -foot tall fence to 8 -foot tall
fence along Walnut and Grayson Creeks, where the levee road was raised, to increase
treatment plant security. Overall, the District has over 20,000 feet of fencing, most of
which is 6 -foot tall chain -link and was installed in the 1970s.
District staff prepared the plans and specifications for the project. The Engineer's
estimate for construction of Perimeter Fencing is $225,000. This project was
advertised on April 27 and May 4, 2011. Eight (8) sealed bids ranging from $110,605 to
$165,805.50 were received and publicly opened on May 17, 2011. The Engineering
Department conducted a technical and commercial review of the bids and determined

that Golden Bay Fence Plus Iron Works, Inc. is the lowest responsive bidder with a bid
amount of $110,605. A summary of bids received is shown in Attachment 1.
The District will administer the construction contract and will provide contract
administration, inspection, and submittal review. The funds required to complete this
project, as shown in Attachment 2, are $135,000. The total cost of Perimeter Fencing
is anticipated to be $165,000.
This project is included in the fiscal year (FY) 2010 -11 Capital Improvement Budget
(CIB) on pages TP -37 to 38. Staff has conducted a cash -flow analysis of the Treatment
Plant Program budget and concluded that adequate funds are available for this project.
Staff has concluded that this project is exempt from the California Environmental
Quality Act (CEQA) under District CEQA Guidelines Section 15302 since it involves
replacement of existing fencing at the same location and with the same purpose as the
fencing being replaced. Approval of this project will establish the Board of Directors'
independent finding that this project is exempt from CEQA.
RECOMMENDED BOARD ACTION: Staff recommends the following:
1. Find that the project is exempt from CEQA,
2. Award a construction contract in the amount of $110,605 for the construction of
the Perimeter Fencing, District Project No. 7282, to Golden Bay Fence Plus Iron
Works, Inc., the lowest responsive bidder, and
3. Authorize the General Manager to execute the Contract Documents subject to
SUBMITTAL requirements.
