Subject: ESTABLISH JULY 7, 2011 AS THE DATE FOR A PUBLIC HEARING TO
RECEIVE COMMENTS ON CONFIRMING AND LEVYING FINAL ASSESSMENTS
FOR SUNNYBROOK ROAD CONTRACTUAL ASSESSMENT DISTRICT NO. 2010 -1
AND DIRECTING THAT THE 2011 -2012 ASSESSMENT BE COLLECTED ON THE
CONTRA COSTA COUNTY TAX ROLL

ISSUE: Work has been completed on the Sunnybrook Road Contractual Assessment
District (CAD) No. 2010 -1 and the final assessment can be established and levied. A
public hearing and a resolution are required to direct that the 2011 -2012 assessment be
collected on the Contra Costa County tax roll.
RECOMMENDATION: Establish July 7, 2011 as the date for a public hearing to
receive comments on confirming and levying final assessments for Sunnybrook Road
CAD 2010 -1 and direct that the 2011 -2012 assessment for Sunnybrook Road CAD
2010 -1 be collected on the Contra Costa County tax roll.
FINANCIAL IMPACTS: The action will allow the District to be reimbursed for project
costs.
ALTERNATIVES /CONSIDERATIONS: The Board may decline to establish the
recommended public hearing date or may elect to choose a different date. However, a
public hearing must be held if assessments and charges are to be placed on the
County tax roll for collection.
BACKGROUND: On July 15, 2010, the Board of Directors ordered sanitary sewer
improvements for the Sunnybrook Road neighborhood in unincorporated Alamo. The
work to install the improvements has been completed, final costs are ready to be
totaled, and final assessments for each property can be determined. The Board will be
requested to confirm and levy these final assessments and to authorize a Notice of
Assessment.
After being given an opportunity to pay off their CAD assessment in a lump sum without
interest, property owners instead may choose to pay for sewer improvements over a
ten -year period. Payments are to be collected by placing assessments on each

property owner's tax bill. The Board must conduct a public hearing prior to considering
placement of charges and assessments on the County tax roll for collection.
RECOMMENDED BOARD ACTION: Establish July 7, 2011 as the date for a public
hearing to receive comments on confirming and levying final assessments for
Sunnybrook Road CAD 2010 -1 and direct that the 2011 -2012 assessment for
Sunnybrook Road CAD 2010 -1 be collected on the Contra Costa County tax roll.
